I tried to spread the word over that poor soul who was arrested for checking on (asking if someone else’s BoA check was good) a fraudulent check he was given in a craigslist scam months ago.
But here’s a reason to hate them even if you don’t bank with them. If you’re in a pickle and use one of their ATMs, it costs you $5 to take out your $20. – $3 ATM fee and $2 out of network fee but, they only have the decency to tell you about one of them. The other will just be a little surprise for you later on. Enjoy.

This is not only for those who have fallen behind on their payments or whose credit scores have dropped but for any customer whatsoever. BofA sent letters to its customers saying that they would more than double their interest rates to as much as 28% without giving an explanation for the raise in rates.
Business Week calls it, “a credit card you want to toss.” We couldn’t agree more.
I hope the next advertising tagline is: “Bank of America the scourge of the banking industry.” They can afford to be truthful. No one can do anything about such a behemoth.
I agree with the comment about BOA. I have had a checking account with them for some years now. I have never reported any fraudulent activites to them until I got fraudulently charged for gas. I got charged 29 dollars which was the right amount for the gas then I got charged $63.32 two minutes later. Obviously I could not have bought 90 dollars worth of gas into my chevy cavalier. I reported this to BOA they denied my claim after “researching”. I called them and requested to speak to a manager. The reponse was since the card was used on the pay at the pump outside. I must have swiped it twice. They suggested that I must have bought more gas for my self or put the gas in a cannister. I am moving my account tommorow. Run from BOA. Run run run because they would kick you if you are down.
My card was erroneously charged after a gas station visit, unfortunatly they drained my account while I was en route across country and I didn’t realize it until I was trying to pay for a hotel room later that night. BoA’s reply: “Sorry, there’s nothing we can do about it.” The debit card had the VISA logo so I was mistakenly under the impression there was some protection. Wrong!
Words can not express how hideous this bank is. Incompetence abounds and they have the WORST customer service on earth. I actually asked one of the poor saps on the phone last night how he can possibly like his job when he is affiliated with such a tiresome, inflexible entity??!!
They pissed me off so bad, I thankfully closed my credit card and moved my balance to a much friendlier credit union. Go USAA Federal Credit Union!!!
B of A loves to take you and your hard earned dollars and come up with some anal reason to take it from you. On two occasions my account went into the ‘red’ by .2 cents and another time for 30 dollars on the same day it happened I put money in to cover the negative, and on the first occasion (0.02c) I got 3, yes THREE overdraft charges and the second occastion (Feb 2008) I again paid the ‘negative’ off before close of business.
The very next day I check the account and there’s a overdraft fee charge again. So for 0.02c it cost me 100 Dollars (3x overdraft charge $33) and once again. I’ve been with B of A for 6+ years and I thought Well’s Fargo was bad!!. I am not ‘Rolling in Money’ and one these two occasions I had to go above and beyond to correct the ‘Charges’ they leveled at me 2c cost me $100 dollars and that’s no joke!!

They did the same thing to me. In my case I used by debit card thinking it was my credit card with the same photo on it and it shows VISA. Come on we all make mistakes. They didn’t notify my of the overdraft which was for 8.00, now I owe them an extra $70.00, which I really need. Also I went in on a Saturday morning waited 30 minutes, was told to come back on Monday to speak to a “Manager” and it would be taken care of. So, on Monday I wait 1 hour to speak to the “Manager” and he just looks at me and says There’s nothing I can do. I’ve had other problems with them. The day after I gave blood at the blood bank (to save lives), I was a little brused and although I go into this same bank time and time again, I was made to wait while the teller checked to see if my check was a fraud. She must have though I was a drug addict or something. Although, I look like a goody two shoes, I am hispanic after all. I bet she’s never given blood to save others a day in her life. I HATE BANK OF AMERICA. I did cancel my checking account and will never, ever use their credit card again. Also, I have a big mouth and will be telling everyone I know, and everyone I don’t know of their bad customer service. Spread the word, start a movement. They are liers and cheats!!!!!!!!!!!!!!!! I’ll be looking into moving my mortgate as well.
I’ve banked with BofA for 15 years – Mortgage, multiple checking accts, savings, credit cards, everything- and I’m slowly pulling the plug.
I’m being fee’d to DEATH. I’m about 1/2 moved to WAMU, and I even moved my mortgage. A complete hassle, but worth it to me on principle. I HATE THEM.

Have you heard about B of A’s new policy regarding PENDING overdrafts? Apparently they can charge you an overdraft fee if it even LOOKS like you MIGHT overdraft! Even if you transfer money or put cash in, you will still get the overdrafts before the charges even clear!
Just had it happened to me. they actually charged my account 4 $35.00 fees because of prediction. The decided that I might go overdrawn before my direct deposit goes it at midnight and they made sure to get there fees in before the deposit. I still don’t know the Possible transcations they are charging me for. Of course there ever so unhelpful about fixing it. I would be more grateful if they just said f%$^& you your screwed. rather than play the Mrs. game as they talk to me like a child. BOA is the devil and I hope they burn to the ground.

When you make a mistake we will see you back here telling your story like the rest of us. MOST people make mistakes, forget about bills coming out of their account, use the wrong card, spend a little too much, etc etc. As Americans, we’re told to spend spend spend! Obviously in that spending frenzy people are NOT going to keep up with their finances 100% of the time. That being said, just because people make mistakes doesn’t give a corporation such as BoA the right to profit off of those mistakes, but profit, they do, greatly.
Apparently you have not experienced situations mentioned previously, but believe me, you will. Since I have moved my accounts out of B of A, I have not experienced one problem, outrageous fee, or increase in my interest rate. And when you open an account, you accept the terms and guidelines. But it really sucks when the terms and guidelines are constantly changing and you still have to accept them because you are indebted to the bank.

heres one for you. I set upi online bill pay with them. i made my Mortgage payment for the first of the month. Well in april they decided they wanted to pay it int he middle of the month 2 weeks early. When I saw what thedid I called the bank. They “nice” rep I spoke to said no probelm he’d fix it. Even said ‘ like it never haooened” . i foolishly thanked moron. I checked my account and saw the money was back in my account. So i decided to pay all the other bills Inormally pay in the middle of the moneth utility etc. Wel the very next day BOA took the mortgage money out of my accoutn again. I call to say WTF, The response was I don’t now who you talked to. sorry, I have heard of this happening before. Don’t know why it does that”. All the normak placating bullshit they give ou before they bend yu ever. I was transfered 4 times hung up on 2 of them. Nobody knows what to do or who touched my account last. ( Considering it’s a FEDERAL BANKK, shouldn’t noted have been written) Come down to it they told me to call my mortgage company and ask for the money back. Funny thing is BOA had just purchased my Mortgage and I asked for the money back. They told me thay can’t helo me and that maybe I should not use online bill pay because it’s unpredictable. BoA is trash. I am very good with my money but eventually they did screw me as well. On 5 different calls regarding the same transaction I was given false information from their representative. It resulted in making me look like an asshole to the person I was trying to pay as well as taking 3 weeks to carry out a transaction that should have taken 4 days.
Just recently I noticed that now I have to pay a $3 transaction fee to transfer money out of my BoA account (electronically) Not long ago it was free. BoA sucks on multiple levels. Run from their business.
I had a horrible experience at Bank of America at Tri Cit Plaza in Vernon, Ct. There are no words to explain how bitter I am toward that bank and the way they handled a situation. Are there any suggestions on who may be the highest in command to make a complaint to or the correct agency to make a complaint to that will actually respond and maybe do something for you knowing you have a serious complaint and that you are 100% correct.
I made a telephone transfer on June 2, 2008. However, BofA decided to make it appear as though I had made said telephone transfer on June 3, 2008 so that BofA could tack on some OVERDRAFT fees at their leisure. They are predators. They deserve to crash like all the firms that engage in fraudulent practices. Does anybody know where to go to notify of these practices? Attorney General? some banking regulatory agency, if so, what? I know I will never recover anything, but I want to add a little grain of salt to their history as thieves.
Bank of America charged me roughly $150 in overdraft fees for two “seeming” overdrafts – neither of which ACTUALLY overdrew my account. Yup. Awesome bank.
I got 5 x $35 overdraft fees on one account that went red, despite having 3 other accounts at BOA with $20K in credit that earn a measly .9%.
I went to talk to my local banker and was given a toll free number to call!

On Friday, June 20, 2008, I walked into the Parkland Branch BOA to make several deposits, cash a check and get my payroll out. I was asked to leave when I asked if the bank could verify funds on the check.
I was charged $24 dollars last month for service charges on my SAVINGS account with BoA. Those charges are for a CHECKING account, not a simple old savings account. I’ve had this account for three years and this is the first time something like this has happened and they are refusing to refund me my money. So I’m closing it tomorrow and opening a Suntrust account, SCREW BOA!!!!!!!!!
I went into a bank of America bank to cash my payroll check likes always asked the teller to cash it I got some money cash back and deposited the rest, 2 hours later I was on the phone wasting my time with bank of America to get my money available to me it took me three hours to get some where with then, talked to 1 800 representative transferred to a manger and the redirected to the branch where it started later, manger promised to make some type of temporary money link, now that I have incurred all the overdraft ,insufficient charges they say that there is no way someone could make a temp link, so they lock me out of my money and the charge me ,I am no bank the reason I work is to have the money but I am learning my lesion that any bank is better the Bank of America I think bank of will screw you out of your hard earn money don’t worry they will find a way
The Swedesboro, New Jersey, Bank Of America branch opened an Escrow Account; for my apartment. They never contacted me, or obtained my signature. The landlord/owner’s husband handled the trasfer of the Escrow Account, to Bank Of America. Unfortunately, he did not tell me – and then refused to tell me the Bank that he had moved the Escrow Account into. After several months, the husband finally told me where the new Escrow Account was located. I tracked down the Bank Of America regional management office, and complained. The regional management office assured me that they would look into the problem/matter. I HAVE NOT HEARD FROM THE BANK OF AMERICA SWEDESBORO OFFICE – OR – THE REGIONAL MANAGEMENT OFFICE SINCE THAT CONVERSATION, WITH THE REGIONAL MANAGEMENT OFFICE! *** Thanks For Nothing, Bank Of Amercia. It just so happened I had a ‘Priority Customer/VIP Customer’ Credit Card that was being managed by Bank Of America. I cut it up, and put it in the recycle bin; and then called Bank Of America to say ‘I just canceled my years long held credit card. I refuse to have any dealings, with you.’
I was approved for a line of credit in March 2008, they set a closing date for a week later. They pushed the date up a week, then a day, then a few days. This went on for 12 weeks! They BOA declined the loan. Then BOA called me back and said they made a mistake, and I would get the loan, but I had to wait another 25 days. A few weeks later the declined me again! They said I never qualified for a loan in the first place. I went through 14 weeks of hell, while my BOA credit card upped my minimum payment up to $1,900 a month. They refused to lower it because I was going to pay it off. They BOA lady on the phone told me, they wanted me to fall behind, and would only talk to me when I was behind. EVIL!
Why did they not just refuse me and let me find other options?
What was a just hump I needed to get over, is now a full blown crisis.
I haven’t been a BOA customer long enough for them to screw me out of any money, but I hate them already. On June 4 I opened a checking account with them, for the sole purpose of traveling out of the country July 6–August 16. (I didn’t want to take my regular CHASE ATM card with me in case I get robbed.) It is July 2 and after numerous call I STILL haven’t received my ATM card. I haven’t received one shred of correspondence from these people. I’ve called my “personal banker” and he claims the card has been sent, then cancels that one and orders another one to be overnighted to me. So now I’m probably going to have to take several thousand dollars worth of traveler’s checques with me on my trip, instead of a convenient ATM card. I’m canceling my account if I don’t have that card tomorrow. A month is, I believe, long enough to send a new customer everything they need to use their bank account.
Ok these guys are bastards!!! I actually bank at the wonderful Viewpoint (where I have never had problems) but my fiance’ banks at this hell hole.
They have not only taken (in the last week) $140 in overdraft fees (for not even being overdrawn) but have taken power away from their personal bankers so you can only deal with people over the phone, charge $4.50 if you want a money order (customer or not) and mind you they are 50 cents at Race Trac, but have been completely rude about everything even though we are not being defensive, rude, or impolite.
Its mindless (f) ducks like number 8 “hello” (can’t even write your name… coward) that allow banks to constantly steal money like this and have poor customer service. Of course all banks have fees like this but they don’t all use them like a hooker uses penicillin.

My husband and I recently went to deposit a $13,000 CASHIERS CHECK, which should be like GOLD to a bank, but BofA the bastards decided that they needed to hold $8000 of it we both thought ‘fine we can live off that for 2 weeks’. So we took out 2 grand that same day and paid for things we needed. The next day we’re getting ready to go and pay our rent and utilities and I’m checking the site and it says we’re $15,000 NEGATIVE! I’m pissed and I tell my husband we had to go to the bank right then. So, we get down there and the branch manager asks my husband why he doesn’t have an account with me, he says to her ‘At this point you aren’t really selling me.’ We jump through all of there crappy little hoops with the special associate and she tells us that she can only remove part of the hold for $8,000 that the teller did the day before. The woman tells us that if we get a signed copy of the front and the back of check showing that its paid that Risk Management with release all of the money. My husband told the associate that after this was over we would never deal with them again. It took about another 4 days we send them the copy and they tell us that I’ve never had enough money in my account to be able to ave this money with out holding it or something. So, we are JUST NOW about to go get the money out of the account and close the it TODAY it took all of THREE WEEKS to clear a CASHIERS CHECK. For Christs sake I’m considering putting together a group over rallies to burn down BofAs everywhere.
Annais. The holding of Cashiers checks and other deposits is a federal regualtion. Look up Regulation CC, blame your government, not the bank.
Blogger, your facts are wrong. If you have a bofa account, you do not get charged anything for using BofA ATMs. If you don’t have an account, we will charge you for using us as a service.
Your bank charges the extra $2. Don’t have an account with BofA? You are more than welcome to use your own banks ATMs.
Holden, this is not true. I have a BoA account and get charged a fee if I take out money from an ATM at the local mall because it is not connected to a branch. It’s called a convenience surcharge.
I also want people that have old Versateller accounts to know that they are now being charged $5.95 per month just to have an account with BoA unless you have a paycheck with direct deposit going into said account. I have had a Versateller account with BoA for nearly 15 years and just discovered recently that earlier this year, that “product” has been discontinued. I read the information that the bank sends to me and believe myself to be an informed consumer. At no time, did I receive any documentation, in plain English, letting me know that this was about to occur or had already happened.
I also have a BoA credit card and had been making regular monthly payments when all of a sudden, my interest rate went up unexpectedly. When I called to negotiate the terms (having pretty decent history with the bank), they not only told me that they would not lower my rate, but that they were also going to lower my available credit because they felt I had “enough.” Whatever…
I also have an old free versateller checking account that is being charged monthly maintenance fees. I am closing the account tomorrow. Please report the problem to Green Welling LLP. They start class action lawsuits and are investigating BofA. Do a search for Green Welling LLP and then under their website for BofA and send them an email.

Some people are either too dumb to have a checking account or dont give a $*!t about paying $35 for a cup of coffe. If you were smart you would read the little white book you get whe u first open the acct and maybe you would not get all those overdraft fees. Its not the banks fault that people make purchases when they dont have money in their acct. banks spend millions of dollars a year to provide services to help dimwits manage their accounts. Online banking, customer service call centers, personal bankers, atm’s, automated phone systems, and even check registers, which is the best way to keep track of your money, were all designed to help people manage their finances. People these days want to point the finger and not take any responsibility for their action. Imagine if banks only charged a $5 overdraft fee, everyone would be overdrafting thier acct like crazy. Anybody that does get those fees deserves it and if they dont learn from their mistakes it’s their own dam fault. I was a banker for 15 years and never heard a single thank you for paying a mortgage where there wernt enough funds, only complaints about the overdraft fee.

I won’t bore you all with the full story, but we recently had our website hacked. We have a BofA account setup soley for that site. All transactions are handled electronically in and out of it. As soon as our IT realized the situation they took the server down. I contacted BofA and requested that they reject all payments until the situation was resolved. They said they could not do that.
The long of the short of this is that once we were back up I logged on to the banking center to find a negative balance of $721.00 created by 20 $35 service charges. I wasn’t happy but suspected this would be easy enough to rectify, so I headed down to my (Wiles Rd., Coral Springs, FL) branch.
I got a slew of apologies, and spent a lot of time on the phone with a lot of people subsequently, but the ultimate upshot is that they conceded $200 in credit.
We’ve not decided where to go yet, but after nearly 20 years we are taking our business lock, stock, and barrel elsewhere. And I don’t get the feeling that they care!

You sound like a reasonable person so explain to me why when we deposit a check (we’re a small business and every deposit is life or death) it takes a long time to clear but when a payment comes in BofA speedily cashes it knowing funds are in the coffers yet immediately throws in that $35. Perhaps a bank one has been doing business with for over 20 years would have a bit more consideration — in the real world — when they didn’t have get the $ for end of year bonuses for the CEOS. But obviously you work there so why am I thinking I’m dealing w/ someone who would care? (rhetorical yes, vented better)

My story is not banking with them, but working for them. I worked for them for 4 months before I had to move to a different state for financial reasons. When I was hired they said they jumped through hoops to allow their employees to take their jobs with them. I gave them over a months notice to transfer me. They did not get me an interview until a week after I moved. Then made me feel I had the job and had me come in for another interview. Three days later they said they didn’t trust me to be good enough at selling products. All of Bank of America employment is based on how many sales you make a day. It’s complete bullshit. They teach you to basically bully people into checking accounts and when people say “no”, try to urge them anyway .
Anyway, they sent me to another interview in the call center and though I had great reccommendations from my previous manager and had already worked for the company, they also did not hire me.
Bank of America is a terrible company to work for. If you don’t sell enough of their terrible products, you are worthless, no matter how good you are at your actual job.
If BOA is so fantastic as some people have written, and obviously one current employee who contributed… why does the BBB have almost 6,000 complaints regarding BOA.. their customer service and their practices.
My experiences go as follows… I make a purchase, I write it in my checkbook, etc. One day my account is fine and in the order that I purchased things, etc. The next morning it’s all switched around, including deposits and I’m at a negative balance. According to the “lovely” rep .. they think customers want their purchases to be taken out of our accounts from largest amount to the smallest amount. I’m a customer. I want my money taken out when I use it. I want my money deposited when I have it. It is too difficult for BOA to process purchases as they come, so they arrange them for their benefit.
I’ve closed my savings acct as of today and am in the process of scanning banks to change my checking account who have more consumer-friendly practices. I’ve asked many people who have different banks and when I explain the “largest to smallest” purchase policy, I get looks of disbelief.
Even better, ask the next rep you talk to if THEY have a BOA account. I hear “no” more than “yes”. BOA is the most non consumer friendly bank on the market and their practices help coat THEIR pockets, not of us consumers. I simply cannot afford to be a BOA customer.
In addition, I work for a relay service and I have seen myself first hand that scammers can contact BOA with your name and social security number and each rep I have seen has no problem assisting them, transferring money to their accounts from actual customers. It kills me every time to think that BOA will gladly help Nigerian scammers, but ME.. a valid customer, I might as well go sit on it.
DO NOT BE A CUSTOMER OF BANK OF AMERICA UNLESS YOU LIKE TO THROW YOUR MONEY AWAY. Period. (and of course the employees of BOA will defend their bank and blame us…….. THEY NEED OUR MONEY IN THEIR PAYCHECKS!!).

I hate how they switch stuff around like that! when i complained about it in the scottsdale AZ branch (scottsdale road and lincoln) the manager sat there with a straight face and told me they don’t do that! so i asked if 6 negative pending transactions (should have been only one if they hadn’t rearranged them) stacked in ascending order of value was just a coincidence. he said yes, i must have made the purchases in that order. i wanted to punch his fuckin teeth out. nevermind that customer service has explained to me over the phone that yes, they DO do it that way and that most customers prefer it. Funny how the customers don’t seem to agree!!! Also, i made a deposit of $240 the same day i went overdraft. WAY more than enough to cover the difference. Did that stop them from giving me SIX $35 fees? of course not, they just waited 2 days to clear my CAAAASSSHHHHHHH deposit, and called it overdraft. i am done with these scumbags. they can all rot in hell.
Hate is not a strong enough word for how I feel about BofA. I had a credit card with them and when I paid my bill online ON the due date it was considered late because it was made after 5 pm EST. Fine, I should have read the fine print on the back of my statement. When I called a CSR about reversing the late fee she agreed that she would do that since my account had been in good standing over the last 12 mos. When I receive my statement the following month, no reversal. Called into their 800 number, spoke with another CSR who was terribly rude and said they never do that and argued with me (after answering my call by touting how they provide the best customer service). Decided to pay off that stupid card in full and then today, I receive a another bill for $12.00! They are shady when it comes to calculating finance charges so that even though you pay it off in full, they can still make money off of you. BANK OF AMERICA IS A CROOKED FINANCIAL INSTITUTION!!!
I work for a title company that does mortgage with them. They are HORRIBLE! They tack on 2nd mortgages that bwrs find out about at closing. They charge HUGE fees and make up good names for them so they sound valid… THE WORST CUSTOMER SERVICES EVER… I WOULD NEVER BANK WITH THEM EVER. I am very sad that I even have to work with them.
As a long time BA customer,I decided to close my account because they’re thieves.I called to ask a question yesterday,agent made a racist remark.I wanted to close my account due to this,she said “you only want to close your account because you did not like my answer,not because of service”.When asked for a manager,she refused.I wrote several letters to BA,I got 5 same automatic responses from 5 different people:”sorry you had a bad experince,we hope to have better relations in the future.”

Holden is right, the government has Reg CC (Funds Availability Act) to protect both – the consumer and the bank. However, if anyone should be in complete violation of this act, I would certainly agree that B of A is the absolute worst. For those who don’t know this already, a Certified Check, also known as a Cashiers Check or Bank Draft, can only be ‘held’ by your bank for a maximum of 1 business day regardless of amount as long as the deposit was made in person and it was deposited into an account in which the payee(s) is/are listed as owners/drawees of such account. The only exceptions I know of to this would be if you deposit this check in a night depository box or ATM machine and the pick-up had already occured for that day… the other exception being if you have kept an unsatisfactory (or suspicious) account where checks have been returned/bounced, then the bank can place an ‘extended’ hold on your check. But when things like this happen to good account holders who followed the rules outlined by the Federal Government, you should not hesistate to file a complaint with the regulatory agency – NCUA for credit unions, and FDIC for banks… you could also file a complaint with the OCC and FRB (for banks) to help expedite your claim if applicable. If that doesn’t work, contact your senator and House members… they are there to protect your rights, especially when the banks flex their little money muscles.
One of their customer service representatives told me the wrong date for my credit card payment (the 11th when it was the 10th). To make matters worse, I would have actually had to pay on the 7th, as the 10th was a Sunday and despite their “24 hour Customer Satisfaction hotline,” they can’t process payments on the weekends. In any case, up go the interest rates and the fees…bastards.
it is so funny how they have a charge for everything like overdraft protection transfers 10 dollars to use my money in another account to cover an overdraft and this b.s. with the overdraft fees if the transaction is still pending and if 1 item in a day overdraws your account they can charge you up to 5 overdrafts in the same day if you made other purchases in the same day you overdrew your account so a couple of dollar overdraft can take you for 175 dollars what a scam and for the first year i had my bank account open i was never charged an overdraft fee and then when the year was up they tryed to bang me for a bunch of overdraft fees and i went in to the bank and gave a manager a bunch of sh** and he gave them all back to me wow what a bad experience for my first bank now i see why my grandfather does not deal with banks

At least they responded to you. I’ve been trying to close a business money market account since February 2008 and NOT ONCE have they done anything whatsoever to close the account. Here was my last letter, still unacknowledged after 39 days.
Enclosed you will find my THIRD REQUEST to close my account – please note that the first request was made in February.
My assistant followed up a month later to ask what the hold up seemed to be and she was told by Mary Naughton that I should re-send (via overnight mail) the request to 4109 Gandy Blvd.
That was done.
A week ago, we still had not received the check and my assistant called again.
This time someone named Carl said that no signature card could be found and so there was nothing to compare my signature on the request letter to. He said that he’d send out a signature card to sign and return with a copy of our Articles of Incorporation.
I told Carl that I understood the policy (although I don’t know how one cannot find a signature card, but then again it was originally an MBNA account) and that I looked forward to finishing jumping through the hoops so that I could get my non-profit’s money.
Today I receive the enclosed letter, telling me that you “do not send copies of signed signature cards that we have on file” and that “to close the above referenced account we need a request in writing, singed [sic] by the owner.”
No kidding, I’ve only done that twice already (although I only wrote, signed and mailed the letter – I am a lousy singer; plus the past tense of “to sing” is “sang” not “singed.”)
So let’s recap. A customer asks to close an account. You ignore it.
The customer calls to find out why it has been ignored.
The customer is told to overnight a copy of the letter. Done.
The customer is ignored for over four months until he calls again.
The customer is told that the bank can’t find paperwork that had to exist at one point or the account could not have been opened. But the customer is given no explanation as to why no one bothered to tell the customer why his account was not being closed.
The customer is told what needs to happen to close the account – primarily a new signature card needs to be completed.
The bank sends a letter instead of a signature card.
HOW INCOMPETENT IS (Almost) EVERYONE WHO WORKS AT BANK OF AMERICA?
I’m not even a BofA customer and I hate them. I’m selling my house. My buyers are going through BofA. They have delayed closing 3 times now, all because they didn’t get the right paperwork from the buyer from the start. Then they had the FHA appraisal done late, etc. just one thing after another. Whats worse is I can’t do anything about it. only the buyer can take legal action against them.
I HATE BANK OF AMERICA with every cell in my body. I signed up with them for their “interest free – payment free” credit card and never received a bill and/or e-mail for a payment due; apparently I’ve past my due date that I DID NOT know about, and now I have to pay an enourmous late fee and I’ve lost my priviledge to the promotional rate FOR A MISTAKE I DID NOT CAUSE!!!

I had 4 overdraft charges which fortunately was credited back to my account, but those suckers never recorded it!! When I called back to ask about the same claim they had no idea what I was talking about and made me feel like I was making the whole story up! They hire losers who probably got bullied in high school and make us customers feel miserable. Oh, and what about calling and waiting and having your call drop when you have used up 30 mins of your minutes??? And you can never get the same person on the phone!!! Why do I have to explain my situation 100 fucking times????? Thinking of going to wachovia or Wamu..
An update on my story fromn a few days ago…the buyer was so mad he went into his BofA office to talk to his loan officer. He had to wait 3 HOURS! i cant think of ANY company that would treat their customers this way!
Their overdraft fees……CAUSED OVERDRAFT FEES!!!! WHAT THE BLOODY FUCK!!!!!
Their own overdraft fees caused my newly NON-overdrafted account to go BACK into overdraft, THEN four transactions conveniently went through after the overdraft fees.
Do yourselves a favor, BOA. Follow in ENRON’s footsteps already. We see the greed, just let somebody nail you for it.

The second article is posted explaining a little about the credit cards (not just debit cards to correct Allen) BofA is issuing to illegal aliens. The way that works is the bank knows that a good proportion of those people will default on their payments and will ultimately end up in a charge-off. The bank can then write off these fees and receive a huge tax break from the government, thus us, it’s people. Basically the bank has found a good way to steal from people who are not even it’s customers, let alone the amount it takes from it’s customers.

Why U Overdraw – Congress & BOA – Ho’s N Pimps
If you think back a few years the banking lobbyists got a big change pushed through congress which changed the bankruptcy laws… and at the same time changed the banking regulations so that banks no longer are responsible for providing you with an accurate daily balance. This is around the time that on-line bill pay and trash “fake” credit cards were really pushed by BOA and others. They know dam* good and well that they werent going to make money off of interest or property anymore so they figured they would make software changes to confuse the low end consumer as to what his / her true balance is and hope they overdraw based on what they see on the computer or over the phone. Well it works very well doesnt it? Its the equivalent of making 1000’s of percent in interest. a $35 overdraft fee for that $2 cup of joe? Wow! wish I could loan money like that! Take this back to your congress person(s) they are the whores that were so easily bought. You don’t hear any of the Presidential Candidates speaking about banking reform do you? Hmmmm… how much money do the banks and especially BOA contribute to campaign funds and how many lobbyist pimps provide “goodies” to our elected officials. Should make a good investigative report series eh? Write your Congress people!
My wife and I have had a joint account with these professional thieves for only 3 months now. She gets paid every week. I deposit the check every week on the same day. It is always within a certain amount of money(she has to work 37-40 hours). We have NEVER overdrafted ourselves, NEVER wrote a bad check, and NEVER deposited a bad payroll check(she works for a big company that is all over the country). I check our balance every day, sometimes twice a day, which is why we have not screwed up. Nothing wrong, right? No. They have to hold our check suddenly. I look in there, and I have four overdraft $25 fees. I call them, the lady returns them. Good. The next day I have four overdraft $35 fees, and an insufficient return fund fee for $35! My wife calls them and they can’t do anything until the funds clear the day, which is 5 business days after the deposit. I call them an hour later, and they take the hold off the check and refund all the overdraft and insufficient fund fees. Good. We stupidly deposit her check again. Same day, same company. Today I have another $35 overdraft fee from being overdrafted from THEIR overdrafts, and they hold this check too. The lady on the phone can’t do anything, nor her boss that I ask to speak to. They could do it yesterday, but not today. So if I cash this check at a check cashing place, we can have the money right then and there, but if I have a GOOD history with a HUGE bank, they don’t trust the same check from the same company all of a sudden. I need to buy a *ucking gallon of milk for my 1-year old son DAMN IT! Also, the insufficient fund fee was for my CAR INSURANCE! What if my car gets stolen? If I knew who was responsible for this bull*hit, and they were standing in front of me, I don’t think I would be able to hold back my anger and not hurt them. When this *hit is over, I’m going to a smaller bank. FUCK THEM.
With all the economic problems lately, I’m afraid to change banks just to have B of A buy them! I liked them fine until I had an overdraft. Instead of allowing three smaller amounts to clear with no problems, they put the larger (unable to clear) amount in first and then charge me $35 each for all the others. I called and said I had the money in the account to cover everything but one item and it didn’t matter. They would not reverse the charges. Makes me sick because I work and go to school and pay my own bills and I was short $140 that month because of this. It was uncalled for.
On Friday I had to take my car into the shop to get fixed. On Saturday my paycheck went into my account by direct deposit. On Sunday I paid my car payment. On Tuesday I went to pick up my car from the shop. I knew we were cutting it close; by $1, so I went directly to the ATM after picking up my car and deposited $60 into my account to cushion the account. I got a receipt from the ATM and it said that I had a positive balance of $61. I then went to the grocery store to get food for dinner. On Thursday morning I checked my bank account and they did not post the $61 deposit until a day after I deposited it, but the deposit transaction says it took place on Wednesday. B of A took my entire account down to 57 cents! I spoke with 3 different people on the phone and they all told me that as soon as a transaction takes place the funds are automatically gone. i totally understand that and that is fine, but I don’t understand how that can only work for debits and not for deposits. It is obvious that they are only working towards their advantage. I can not stand this bank, they truly do steal from hard working people. They are thieves!

I had been a customer for years, please tell me why I was charged two bounced fees $35 a piece and when viewing my account information online, I had NEVER withdrawn my account to begin with. Their explanation was completely foreign to me as well. “Oh well it looked like you had money, but you actually didn’t.” Uuummm, if I am pulling up the information online, deducting all my pending transactions, then what the hell are you talking about ahole??!!! Steer away from your BOA script for a second and tell me, does this make sense to you??? One of the fees was for a .30 cent transaction. You believe that crap??!! Anyhow, I now opened an account with my employer’s credit union and BOA can kiss my a**!
I too hate BofA. Thank goodness I’m not a customer, but I handle the accounts for my mom, who has Alzheimers. They are HORRIBLE to work with. Mom has been a customer for over 35 years (they used to have decent customer service) and has multiple accounts with them. I would glance briefly through her accounts at the beginning of her illness and everything looked okay. It was only later that I realized she was being charge a $20 service fee even though she shouldn’t have been based on the fact she had several linked accounts totalling a large amount of money.
When I called to get an explanation (I have POA on her accounts), I was told she would be refunded for 3 months worth but to get the rest (going back 18 months) I would need to call the customer service number. Well, of course they’re only available Mon-Fri, during the time I’m at work. I have the type of job where you can’t use a phone throughout the day, so I had a lot of trouble getting them. I finally took a day off and called and after being cut off and being on hold, was told I needed to go into a bank in person!
I did this and what happens? I’m told that they cannot go back that far to refund money. I was lucky to get the three months refunded. And that’s why they send statements so that we can catch these mistakes sooner.
So not only would they NOT refund something that was totally THEIR mistake, I also got a little lecture about not being careful enough to catch THEIR mistakes.
There have been many other problems with them too; among them a refusal to let me opt out of Mom’s CD because now it’s in trust and I’m listed as a successor trustee instead of co-trustee (her other bank has me as co-, not sure how BoA screwed up, but I know it’s their fault). So now she’s renewed at this little pathetic amount, when I could have changed it to a much better rate (or better yet, taken it out and put it in ING).
They are UNHELPFUL and give WRONG information. And feel no embarrassment over their FU*K-ups. I truly despise them. I will never have an account with them, never.

I’ve been working there for over a year and I only recently received my fist pay raise. 20 cents. That is what this huge, multi-billion dollar corporation, that payed $50 billion for Maryll Lynch could afford. I spoke to my manager about this because I was outraged and she said that the company only allows 2% raises once a year. F**K YOU!
For the 4th of July, we were given in an employee lunch, they gave us hot dogs. Then for “associate appreciation week” we were asked if we wanted to have a potluck but we all had to pay $5. WHAT THE HELL??? THIS WAS EMPLOYEE APPRECIATION WEEK AND WE HAD TO PAY FOR OUR OWN POTLUCK???

We have seen on our accounts the changing of deposite dates and withdrawls inorder to overdraft the purchases. then overdraft all the other purchases after they predate the first overdraft and rape 2-3 hundred dollars from our family every month.
Yes we are leaving, but they will pay back what has been stolen from our country, I will not stop telling others and demonstrating against this horrible inhumane buisness.

Most people don’t realize that BOA (and every other advertiser) pays for each click (around $1 each) they receive on these search result ads at the top of the page. If you can get you and your friends to all click a few hundred times in total, altogether we could probably generate over $100K in fees charged back to them — with all the money going to Google.

Well, actually using online banking is the cheapest way BOA can service clients. That’s why when you call they always want you to go online. The most expensive ways are calling them and going into a banking center. I only know if because I used to work there.
Enida, Kalynn and Marc, I am also interested in this class action lawsuit against BofA. There are many thousands of cases like this and as one of my earlier posts showed 45.6 billion hard earned USD seized with these charges MOST of which was probably illegally done.
I’m calling a couple of lawyers around here for some free consultation. I just had the dates on some transactions changed to before a check was cashed so I could get charged.
I’m going to start with the consultation at first but I’ll ask around because we’ll need a high power firm to be able to do this or BofA will drag it out and pretty much bankrupt any lesser firm with their overpriced lawyers if we even have a case.
Anyone that is interested to join the lawsuit (again, if there is one at this point) I will get the process started. I know there is a LOT of work to be done but I am very dedicated to whatever part I may play in helping take down BofA. Even if just down a notch.

Getting a lawsuit like this started will take the participation of MANY people but the participation of the many is about as simple as a signed copy of something the law firm will send you. Agreeing to help out or participate is not going to be a painstaking ordeal for anyone interested, I’ll do all of the work that needs to be done, but would love any level of participation from anyone effected. This is a giant corporation stealing our money. Please search out others like this experiencing similar issues and get them to email me as well.
One voice is nothing but the tens of thousands if not more experiencing this kind of fraud is more than what we need to fight back. We need more people to do this. I will spearhead the lawsuit all I can for everyone that participates. I will dedicate my time and whatever resources I have to it as well.

BofA gets the major douche of the day award and I am glad I found somewhere to vent about it. There really should be a support group for pissed off BofA customers.
I finally nutted up and canceled my account today after almost an entire lifetime – 31 years – of being a loyal customer. In that time I’ve had more negative experiences than I care to recount… but what the hell. I’ll try anyway.
First, I have to mention that I worked for the blood suckers as a contractor during college and my family’s history as customers goes back even further than my own. I’ve flowed thousands of dollars through their system and paid them countless hundreds of other fees due to my own negligence. I’ll avoid recapping every one of those – suffice it to say we have a history.
The first incident I’d like to recount happened when my girlfriend was working at BofA in Concord, CA. I dropped her off at the office and stopped at an ATM – one of the new ones they had just released – to get some cash for the day. When I walked up I saw the big new flashing landing strip where you enter your card and the new picture of an actual card. I slid my card in and strangely heard a “clunk” before noticing that my card had slid right under a little sliding door that was supposed to be closing the machine off. The lights and screen were on, but this sliding door which wasn’t locked was supposed to prevent something from happening. Anyways, I looked in and saw only the guts of an ATM machine and my ATM card sitting way at the bottom. I tried to get it out to no avail. As I stepped to the side to consider what to do people kept walking up to put their cards in. I couldn’t let people fall into the same fate so I stood there and warned them all – one by one – for about 5 minutes. Then I asked one of them to wait and assume the role of warning guy while I informed them of the issue in the bank. Well, I got into the bank and told some people but they all sort of looked at me with a glazed stare and told me to call the help #. I was a bit flabbergasted and asked if they planned to put up a sign to let people know not to lose their cards and they said no. So finally I asked them for a piece of paper and a pen which they so generously provided. I walked down to the ATM, wrote up a sign, and put it on the machine. Then I called the help # and reported the machine broken. No one thanked me. They told me someone would be by at their earliest convenience. Then I talked to them about the card and they had pretty much nothing for me. No apologies for the confusion. No thanks for going out of my way to help them. They refused to expedite the new card to me. It was horrible. I eventually talked to a manager who told me she was sending me a “special gift” for my trouble. I never got anything.
I’m the idiot for sticking with a bank after that sort of thing, but please try not to let my own condition take away from the horrors that is the BofA customer experience.
Today was the last straw. I was charged $175 in overdraft fees for activity over the weekend. This happened because of a check I mailed to the DMV to renew my registration three weeks ago – the DMV sat on it, I got pulled over and told by a cop that there was no way the DMV received it, and then they took it out of my account unexpectedly over the weekend. So on Monday I look at my account and it’s fine. Then on Tuesday I see that the DMV thing came out and all the transactions I made over the weekend show as pending. So I run in and physically transfer more than enough money to cover it into the account. I repeat – I went into the branch and they told me it would be credited that day. So then I look and my balance is looking fine again. So I get a little gas and food to eat for the night, leaving a good cushion in there for the next few days until payday. Today I look, though, and it’s at 0 again. I received 5 overdraft charges – 2 for coffee that costs $2 each. They charged me $70 to cover $4 worth of charges. That’s just not ethical.
Here’s the problem as I see it. It’s my fault that I manage my finances such that I expose myself to this possibility. I know that. But I think BofA displays the absolute WORST customer focus I have ever experienced from a company. I called to discuss this with them and to talk about my relationship. I believe I acted in good faith to keep my account in good standing given the information I had to work with. They maintained, at every step of the way, that because of detailed processing schedules their hands were clean. I talked to a manager in a branch. He tried to placate me with $40 – but at the end of the day I was still left with the fact that I paid them $70 to front me $4 – and that’s giving into the idea that their online tracking system isn’t confusing and flawed.
I actually had someone tell me today that “well, you still have to manage every transaction on your check book, even if you use online banking.” Really? So you market the hell out of a check card and online banking because it’s “convenient”… and then you tell me that you want me to walk around with a check book and keep track of every one of those $2 convenient charges I rack up because, yeah, it is damn convenient. Well, guess what? You bastards put the idea there in the first place! How about those commercials where the person with cash holds everyone up and gets ostracized? What if each of those people had to fill out an entry in their checkbooks each time? Hell no! No one does that. So why wag a finger at me and tell me these things when I’ve just paid you $70 TO COVER $4?!?!?! You should be treating me like a valued customer cause that’s a hell of a business deal.
Anyways… I’m done. BofA no more. I am moving to the Schwab Investor Checking account. They have zero fees and the highest return on checking around. They also reimburse ANY ATM fees from ANY network – no matter what. Strip club with $5 fees? check. Same goes for Vegas – all reimbursed. If it weren’t for logistics I’d have moved already… and I’d be $200 richer.

I hate Bank of America. With this credit crunch they are now targeting their customers who call in to get a lower interest rates on their credit cards and CANCELING THE CARDS SO THE CUSTOMER CAN’T USE THEM – how do I know this? They told me so and they are going to start canceling most of their customers credit cards in the future.
Bank of America just got millions from the bail out and refuse to help anyone. This is what happened to me – I call BofA asking if there is a way I can lower my interest rate, I have my mortgage with them and another credit card. I have been with them for 20 years. I was never late on any of my credit cards and have good credit. Because my debt ratio is higher than my income the man told me he just cancelled my cards and told me I’d better hope I don’t have any emergencies – he was so rude. The reason my debt ratio is higher than my income is because I own a house, like everyone else therefore they will be closing everyones credit card accounts that own houses. They make no sense and they are horrible to their customers. I want to leave them desperately and I will when the time allows it. WATCH OUT EVERYONE – THEY ARE OUT TO SCREW YOU AT A VERY SCARY TIME!
Get this one. I used a debit card that I thought was on another account. I debited a certian amount and then got a cheeseburger and a movie at McDonnald. The next day I see a negative for FIRST THE LARGEST AMOUNT and then the two 1 dollar charges. I put in money to cover it the next day. Two days later they hit my for 105 dollars in overdraft fees. I put in the rest to cover this and a pending debit that had been there a day BEFORE I charged the three intitially. I went to the bank and they told be to basically fo F..K myself, there is nothing they can do. The NEXT day I get a PENDING on the transfer I put in the day before to cover the f..kers charges. NOW this is the kicker. i had enough to cover the pending charges even from the intitial with out the overdraft fee that did not show up unil TWO DAYS LATER. The AHOLES then charged the account with the OVERDRAFT fee first and THEN the pending charge which was done days before and I got YET another f..king overdraft charge because of the overdraft fees. And they told me they would not charge me an overdraft on an overdraft fee F..KING LIARS. I am LIVID they aholes have STOLEN my money. I hope someone sees these posts and starts a class action suite against these F..KS.
I have been a customer of BOA’s for 15 years; have four mortgages, savings, checking, money market, 6 business accounts, and last year I started getting charged ridiculous fees, and having them hold money that I deposited for 10 business days. Most of these checks are cashier’s checks. This should be the same as cash. WTF!!
I have since started to move my money to a local bank. These guys are actually happy when I show up. No fees, no holds, no BS.
My advice is to go to your local banks and credit unions. You should interview the bankers the same way you would interview anyone else who is handling a large amount of your money.
Ditto what M.H. wrote on Nov. 6. I also called BOA and tried to get a lower rate on my credit card. After being put on hold for at least 10 minutes, the “credit analyst” was rude and asked numerous questions. The first question was am I having trouble making the payments? I have not missed a payment since I opened the account in 1999. Not only did he not lower the interest but lowered my credit limit from 34k to 12k! Thank God I only have a credit card with these Assholes! Will change that soon.

1. The amount of the fees are not realistic. As a profit-making venture it’s far beyond reprehensible. Just imagine it in real world terms. Imagine someone offers to handle your money, charge a fee and take a percentage. Then imagine when someone who knows your secret code walks up to them and tells them that “Frank says give me 200 bucks”. Well, you’re Frank and you didn’t say it. Well, this guy smiles a big grin, hands the guy 200 bucks and then takes 35.00 for himself. Doesn’t sound like such a nice thing, does it? Well, that’s what BofA does, and it’s not just them. Credit unions don’t do it and manage to stay in business. How??
2. They say they go ahead and process payments as a courtesy. How about if the funds are not there, reject it? How is that for a concept? And as far as rejection of a transaction being labor intensive, we all know it’s automated. So that’s a load. No, instead they do you a “favor” and “honor” it. No. If some fraudster tries to process something on my debit without my direct permission, it’s not honorable to go ahead and process it if my account doesn’t have enough to cover it. Especially if it’s not authorized. And once these companies get away with it once, they can continue to do so until you CLOSE your account and open a new one. Protected by Visa is a LOAD. Some of these people know the limits and know that the only way for you to recover funds is to beg them and hope they do the right thing, OR sue them yourself. This will very nearly NEVER result in the refund of fees.
3. It is difficult to manage that which is no longer there. I just witnessed someone lose their income and get massacred by fees because she was unable to get 2 automated payments for tiny amounts to stop. This is after several attempts, assurances that she would no longer be charged and multiple calls to the companies involved as WELL AS calls to BofA warning them of all this in ADVANCE, still resulting in the following….
“We are sorry this is happening to you, but even if you tell us in advance and do not authorize the payment verbally, as long as you originally authorized a single payment to these companies, there’s nothing BofA can do about it and unfortunately the fees will still be charged and cannot be reversed due to policy.”
Anyone who tells you fees CANNOT be reversed, ever, as policy? Do not do any more business with them, period, and explain why. Fees ARE reversable, period. It’s practically the only thing they CAN control in your favor. And when a company has a policy to not do the one thing they can do to protect their customers while they are being taken advantage of, that company deserves none of your business.
Sure, manage your money. Read the fine print. Know of these policies in advance. But to those of you in bad situations NOW with no way out except to hand your meager paycheck over to a bank JUST to cover fees? I have sympathy for you. You’re not alone and you are NOT at fault. You’re the customer and it’s about time you demanded to be treated like one.
In hard times, never let anyone tell you that being out of money is bad management. Our lives should always be as perfect and laid out in advance. But they are not, sometimes. And don’t you dare feel bad about it. It’s hard enough being broke. Hard working, fair, honest people go broke. And people who say you’re whining and stupid, it is my hope that as a learning experience, someone takes everything they have at least once in their lives, due to no doing of their own. So they learn to know how it feels.
I hate them too. A few years ago I was a struggling college student and I had a BOA checking account and ATM card. One day about a month after I had major abdominal surgery I received a statement with overdraft charges and an incorrect balance. Somehow (I) allegedly took money from two ATMs. Once was at a local WalMart at 3AM. This was in the days before we had a 24 hour WalMart. The other transaction was at a local small Subway also in the early hours when it was closed. I talked to the bank manager and his reply was “computers don’t lie.” So I went to the managers of the stores in question, and they signed affidavits explaining that I could not possibly have been in their establishments at the times in question. I took them back to the bank and they waived the transactions. They DID however, make me pay the overdraft fees (which would not have been overdrafts had the errors not occurred). I closed my account immediately and am still happily banking at my small town independent bank.
The story does not end there. During all the time I was trying to straighten the mess out, there were also fees from the bounced checks that I could not possibly afford to pay. I was taken to court, and despite the statements from the managers, I was charged with bouncing checks. So I had court fees and had to pay the businesses back, along with their bounced check fees. Now, I have a misdemeanor. Thanks to BOA!
I couldn’t open a checking account for 7 years. I had to use savings accounts and ATM cards.
Let’s just say I had people help manage my accounts (now down to one because I closed one) and I still paid BofA more money that I had in my accounts. I dislike the bank and all the hidden fee that they don’t tell you about and when you ask them if they have a document about the fees and other charges that apply to YOUR account they are uncertain about how to get you some type document; and when you try to look it up you can’t find anything that makes sense unless you have a lawyer next to you.

I reported earlier I was listed as successor trustee on her account so couldn’t move anything. I went in person on another day off to the BofA in Carpinteria. There I spoke to an actually nice young man (all my earlier experiences were in Glendale with the rudest employees ever).
He listened to what I had to say, reviewed the paperwork and actually seemed to get what I was saying, that my mother was incapable of making changes, that I had POA over her smaller accounts, and that I needed to be able to change the successor to co-trustee (as listed in the trust papers) to manage her bigger accounts.
He showed me BoA paperwork and of course it was not correct. I said, yes, but that is wrong. He talked to his superiors and they could see my point. They suggested I either bring my mom in (she’s bedbound) or get a doctor’s note to declare her incompetency. Okay, I could do the latter.
He then made some mystery calls to get authorization on that and got put on hold and then transferred to the wrong department! I had to laugh as this is what always happens to me. He finally got someone and they just refused. Straight out refused. His superior talked to them to no avail. Nope, can’t do it. If I wanted to change their screw-ups, I’d have to take my mother to court for a conservatorship. Ah… she’s bedbound, I can’t get her in or out of a car… how the heck do I take her to court? And why should I when my paperwork is in order?!?
The poor guy I was talking to was sweating at this point. He knew it was very unfair and ridiculous, but there was nothing he could do about it.
I finally left, and will watch the interest rate on my mother’s CD dwindle to practically nothing when I could get at least 4% with ING or even 3.4% with a credit union.
And today I read of the government’s bailout of Bank of America! Oh, how happy that makes me feel, knowing my tax dollars are going to keep them afloat!
I Hate BOA. I went to them with a check, they put a 10 day hold on it. The check was for $20,000.00. When I told them the check had cleared the bank it was written on, they told me to fax a copy of the front and back and they would release the hold. I did, they released the hold, and the very next day they put another 10 day hold on it. when I asked, they said it was an out of state check, so that was their response.
I let that go, and then went to them to deposit a BANK CHECK for 33,000.00. A BANK CHECK, which should be the same as cash, and once again they put a 10 day hold.
Also this was from the same state, so they could not use that excuse.
I was moving, and trying to pay moving fees, and first and last month and other expenses, and had to wait until my money cleared, or use credit. I have excellent credit, but it is because I manage my money carefully.
I Hate Bank of America, and am transferring my money carefully over to my credit union, but I am afraid of bogus fees, so I have to watch carefully over this account at BOA until it is safely closed.

My husband and I have had credit cards w/bank of America for 15 years. We have perfect credit. Apparently one of our payments hit our account 2 days late. Our interest rate went from 4% to 28%!!!!!!!!! How can they do that???? I expressed the difficulty in making the payment they were asking for. I pleaded for them to just lower the rate to a REASONABLE rate and was told there was nothing they can do?? Now come to find out they closed an account that had nothing to do with the card I called about and lowered the other one to the amount we owe!!! They are sabatoging us!!!! We are paying for thier shortcomings!!!! This CANT be legal!!
So far no luck on the class action. As suspected I’m not finding a lawfirm that will take the case. I have had too few confirmed interests in the suit so it has not really went anywhere. I did not even receive a single email in the account I setup (classactionagainstbofa@gmail.com) so I’m sorry but there is talk but not enough action yet.

Filed a complaint with the BBB today on BofA. I was hit with the Sunday payment date thing, having paid Friday but not processed until Monday, so considered late (although weekend charges process just fine . .. odd, isn’t it). Then, as others have said, when I called in to discuss they reviewed and closed the account. So I have shredded my card and complain to the BBB. It may not be a lawsuit or the best that can be done, but I was livid and at least dealing with the BBB will cost them some money.
A lot of you people are completely wrong, and every situation is different. If you overdraw your checking account on a Monday, then put money in on Tuesday, you’re late, therefore overdraft fees will be assessed to the account. The only way a deposit can ensure you don’t receive any fees is to make it the same day as the transactions, and Bank of America always posts your credits (Deposits) before debits(checkcard purchases, ATM W/D, etc).
ATM Fees: If you bother reading the ATM, you will see. First of all, don’t use an ATM for another banking institution unless you absolutely have to. The ATM will clearly state (no matter what bank they belong to) that it will charge a certain fee then, but will not include how much your banking institution may charge (which you can read in your depositor’s agreement, if you didn’t just throw it out). It’s there. You were just too ignorant to see.
The guy wanting to cash the check then getting arrested: We will never know the complete story, but the main issue is that the dude fell for the scam of trying to cash a check, written for a way larger amount than he was even asking for, and he didn’t think it was suspicious? I almost fell for it once, but luckily everyone told me about the common scam. They say, we’ll send you a check for this amount, you take out yours and wire the rest back or give to a shipper who will also pick up the item you’re selling. It will take a bank sometimes up to a month to find out a check is fraudelent. If you deposit it, it’s then YOUR responsiblity. It’s simple, wait for the check to completely clear, or have them wire it directly into your account, via wire services or paypal.
It’s simple, most people ignore all the signs. That’s not the bank’s fault. Bank of America especially does some shitty things, but charging overdraft fees for someone spending money they don’t have is NOT WRONG.
Bank of America charged me roughly $145 in overdraft fees for two pending overdrafts – neither of which ACTUALLY overdrew my account. And then charged me twice more for the negative balance that they caused with the overdraft fees. Yup. Awesome bank. I even called and tried to dispute the transactions and was basically blown off by the customer service rep. I plan on settling my account and closing it today. I can’t afford to do business with BOA. And for anyone that disagrees you either work for them, haven’t had the pleasure of being screwed by them or have some other type of investment in BOA. Now I get to figure out how to pay my utilities now that I’m -$145.00 in the hole. No wonder the economy is so screwed up ……… we have corporate america stealing from the little people on a daily basis and they isn’t a darn thing we can do about it. 😦
Pending transactions can not cause overdraft fees, no matter what bank. Are you talking about Returned Check Fees? Your story doesn’t make sense if you can’t explain it a little better. What transactions went through the previous business day and the day of the fees? You never are charged a fee for a fee. If a bank fee causes the account to be negative and a transaction posts as overdrawing afterwards, there’d be a fee if that’s what you mean? Help me see what happened to understand.
I opened a bank of america account the day I turned 18 (The only bank in my small hometown), and have had a credit card from them for almost 10 years. It has always been the worst APR (20%) of all my cards, but since ive had it so long i keep it around. How does BofA reward my 14 years of service, by jacking my APR to 29.5% for no reason. This is the last straw, I’m switching to wells fargo.
BofA is the absolute worst and I wish them nothing but a quick demise in this current economic crisis. I only had a very small run-in recently with their customer service since I have been with them for the past 18 years. It was such a small incident but the total ignorance and lack of respect left me speechless. I am baffled as to why they would be so rude and ignorant to a customer who has been with them so long. The choices for altenate banking are so limitless that there is no reason to stay with them and if that is what they want then I am pleased to wave buh-bye. Chase is another joke run by the three stooges- beware if you’re thinking about Chase. The best for me that I have found is WaMu, Citibank, and Capital One. I am simply annoyed with being charged 6 dollars and having to wait in another line to cash one of THEIR checks. I am not a customer and never will be. They have the nerve to ask you if you want to open an account after they treat you like dirt and charge you to get YOUR money from THEIR bank. In my opinion, having a check drawn on their bank MAKES you a customer.
I too hope they go under, but they will just keep sucking up BILLIONS of taxpayer money along with all their petty fees.

As an employee I knew it was time to leave BofA after they recieved our federal buyout money and spent it on buying a greater share of CHINA CONSTRUCTION BANK, we were told it was an opportunity they could not pass up. The banks excuse to change customer/employee rates on loans due to what they call risk based pricing…How much of a “risk” you are now is complete BS, but we had to force feed the line to anyone who would listen. To answer other peoples questions about pending od fees being charged, they are looking at what your AVAILABLE balance is ex: you have 100.00 in checking, you authorize with your debit card 2 transactions totaling 50.00, but they wont post maybe until 3 bus days. Lets say you have 2 checks clearing totaling 75.00, while the holds are still on your account from the debit cards, YOU WILL BE CHARGED FOR THE CHECKS, since your “available” couldnt cover everything even though the debit cards are pending…They are moving up the max od fees per day from 5 to 8 soon here. I worked over the phone and believe me , we are not paid to agree, only do what they ask. But it was time to go.
They posted my rent check twice so naturally that caused me to overdraw. It took two calls and an hour on the phone for them to see that it was their mistake. Apparently it is going to take them 24 to 48 hours to fix it, meanwhile I am racking up overdraft fees that they will supposedly forgive if I call them tomorrow. Wonder how all this will look on my credit after it is fixed.
I really HATE bank of america. I have NEVER dealt with such rude people. Their customer service is horrible. This one girl gave me an attitude over a simple question I asked. And just now, I checked my account online & low and behold, I’m over drawn. I’m over drawn $2.53 & they charge me $35.00 bucks!!! Which made my account go even farther into the hole. Within the past 10 days, I’ve gotten two robo-calls from Bank of America asking me to call them about requested service. However, I haven’t requested service from BofA since the late 1980’s, when I closed my account with them. When I called BofA last week, they insisted that they had dialed the wrong number. Okay, I thought, honest mistake. But yesterday and today I got more robo-calls, this time asking me to call about requested service for “Alicia G—.” My name is Tom and I don’t even know anyone named Alicia, so – again – I called BofA. They said they would remove my phone number from their system. I asked that my phone number be flagged, as I would never be requesting service from them. They said they could not do that; I pointed out that the next time the prankster does this my number will be re-entered into their system. The BofA guy, “Donald Maestre,” told me the only way I could complain about this was to write to 4109 Gandy Blvd., Tampa FL 33622-5518. No email contact? Nope. So I suppose I’ll continue to get prank calls from BofA. Nice, huh?

Then they came back and bought out a credit card I had. I immediately paid off the balance and cancelled the account. No way would I ever do business with these vermin again.
Be very careful paying any lines of credit with Bank of America down. If you are experiencing any financial distress at all and you pay any lines of credit with Bank of America down they will immediately freeze your line.
I have had a line of credit with them for over 10 years. I have used it as an overdraft protection account and the balance over the years has gone up and down. I have never been late on any payments. My mortgage company would not negotiate a modification on my mortgage unless I am late on my payments–apparently if you financially responsible and anticipate that you will be running into trouble as I did in June 2008 when I first contacted them that is not good enough. When Bank of America found out that I was a couple of months late on my mortgage payments, they waited until I made a substantial payment on my credit line and then they immediately froze the line. In the meantime I had negotiated some kind of deal with the mortgage company and counted on the funds available to me in my line of credit to pay them as I had promised, but now that Bank of America froze those assets, I can’t live up to my promise to my mortgage company and I am facing foreclosure.
So here is the lesson: do not pay down your debts to Bank of America as they are looking to punish you for being responsible.
And yes I understand their reasoning in trying to protect themselves against what they take to be credit risks. But it’s hard to see how screwing your paying customers is going to make them money. JP Morgan was asked in the early part of the the 20th Century if he lent on the basis of credit worthiness and he said answered that he lends on the basis of character, I imagine because he thought that would make him more money in the long run. Bank of America seems to think that short term changes in credit worthiness is much more important than long term evidence of character. That mistake is costing all of us a lot by extending the recession and slowing recovery efforts. That’s the real reason why we should hate Bank of America, not that some clerk or branch manager made some mistake at some branch somewhere.
I have had a B of A Credit Card for over 3 decades. My account is in good standing, has been for years. I have been paying a 7.9% interest rates for about the past 5 years. I got a notice in the mail a couple of days ago saying that my card has gone from a 7.9% fixed rate to a variable rate that is of right now 13.9%. No explaination, nothing. I have given them my business and my money for over 30 years and this is how they reward. I will be out of there in days and I will take every friend and family member with me. Let me know if anyone get a class action going.
I was a BofA customer for 23 years. Yes, that means I signed up for my first account in 1986. My interest rate got jacked from 8% to 15% for no good reason…My FICO score is over 800.
I canceled my 11k Visa BofA card today and my 21k MasterCard. I’m waiting on my DirectDeposit to go to my new checking account at USAA before I cancel my two checking and one savings accounts.

I”M SOOOO ANGRY RIGHT NOW I CAN’T EVEN SEE STRAIGHT! >{ Those F-ers. The only reason they’re bleeding me to death in the wallet is because my wife opened an account with them 10 years ago. I had a credit limit of $9K, wanted to go purchase something big, BUT GOOD THING I CHECKED MY STATEMENT, because they CUT IT DOWN TO $5K WITHOUT sending me ANY sort of heads up. Nothin, no, hey we’re lowering your blah blah blah, no email, not even in the adjusted statement. So i called them today to find out why (and i was very nice) and the dude just told me that BofA found a delinquent payment with another creditor, but he couldn’t tell me anything more! Delinquent! WTF, i make six figs, why would i make a late payment somewhere! OOOOOOH!
AND about six months ago I got swindled out of 100 bucks, because their teller couldn’t count my money right, and me not even thinking to check my receipt, left the bank, and my wife asked me about it later that night. So i went back to ask them about it the next day, and they LAUGHED at me in front of 10 customers!!!!! EVEN THEIR MANAGER SAID IT WASN’T THEIR FAULT THAT I COULDN’T COUNT MY MONEY CORRECTLY AND JOINED IN ON THE LAUGHTER! WHAT THE F. So, i asked them to review their video cameras (which are focused on the till), but they told me they can’t see that close (BS). Also, when they researched it, the teller that rang me up that day, was $1600 OVER on her till! AND I ASKED WHY THE F**K she’s not fired, (well i didn’t curse, but wanted to) again… this lady looked at me like i was trying to con her out of a hundred dollars. (When my watch cost more than her car). I told them to keep the money, F’n thieves. OKAY! I’m done. Yes USAA, BECU, even Wells, is much better. Stay away from BofA.

You all are hilarious. I was with Bank of America for years before I decided to start working for them. I still have every account but a few CD’s with them and work for them. All of you who said “Bank of America did ….” or “Bank of said …” without any reason are leaving out a lot of other facts.
Bank of America did increase interest rates for many credit cards because you were priced way too low before. If you had an interest rate of 4.99% on your credit card you should be thankful that it only went up to a 10.99%. You tell me where you can get a credit card for that interest rate, and dont name a single place because they either dont offer credit cards with rates that low anymore or will be increasing you interest rates as well, so keep your eye out.
As far as the fees for the checking and savings accounts… first off, we do NOT charge NSF or ODP fees for pending charges. Secondly, DON’T USE A CHECK OR CHECK CARD UNLESS YOU HAVE MONEY IN YOUR ACCOUNT! Seriously, don’t get upset with BofA for charging you a fee for using your account while you did not have any money in your account.

Times are tough and we’re trying to run profitable businesses so we can pay our employess, buy our dinner, raise our families, send, and pay our taxes. Yeah, the same taxes that BofA begged for and got.
When does our bail out come due? It doesn’t. We just do the heavy lifting so banks can get theirs, welfare recipients can get theirs, and we can get worn out.

ya john and you tell me where that money goes. why is it that a transaction fee is charged ($35). you have insufficient funds in your account and they turn around and still charge a huge $35 fee. that really doesn’t make any sense. i bank with wachovia and they never charge a huge fee for insufficient funds. everytime i have a littel problem i can call and explain and let me be. even if the charge goes thru they only charge $15 and if you call they would refund half. bofa is just a rip company, they don’t give a shit about their customers. they have ripped me off before time and time again. i had a 9,000 loan that i paid off and there was a balance of $5.19 that i asked them to credit after i paid off all that money over the years with interest. they refused to credit the $5.19 and told me they put in on my credit. i was basically forced to pay them that money their bullying antics are really ridiculous. i hate them and would never do business with them anymore, even if they are the last bank in the world. FUCK BANK OF AMERICA. i feel very sad for you….look for a btter job buddy…

i am only doing business with bank of america (hereafter referred to as the retards) because my employer wants to be able to transfer funds directly to me (it’s a somewhat unusual situation), so i set up an account online (it only took 5 days!, and i’ve got more than 7 years tech support and customer service experience) transferred an initial deposit from a real bank (wells fargo, they know how to be a bank) account that is also in my name…then my employer places a transfer into my account, Retards then place an $888,888.88 hold on the account, when i call they say it’s because they’re not sure he really did it, so he calls, that department is closed, then on the following monday, he calls, provides proof of identity on the phone, they demand he show up in person at a branch, he goes there, suddenly the department he needs to communicate with is unavailable, at lunch, for 2 hours…
they then tell him it’s a problem with them not believing i’m me….bear in mind, i’ve called them 6 diffrent times at this point and verified myself more than 10 times on the phone, and transferred money from my account with another bank into this account
so….now i’ve got a new hobby
telling people about how horrible this bank is
they have cost me several domain names, (without access to my account i cannot renew them)
caused me to spend the better part of 1+ week on this
and no end of frustration

I hate Bank of America. In various cities I’ve visited or lived Bay Area CA, Washington DC different parts of MD, nothing but bad customer service. Either I’m ignored after signing the customer service clipboard, or in MD two indian tellers are gossipping and laughing at customers, to rude bitter old ladies in Pikesville who hate their lives and need to be rude (I was trying to get a notary). I am a professional-Bank of America customer service sucks. I recently was charged a $35 fee and I have banked with them for years because of a $10.81 physical check was presented yesterday (which was never shown on my online account or in those stupid recordings and wasn’t what their email alert says) while my direct deposit was pending. They refused to refund the fee–a couple or few hours difference and the check was never shown to be processed on my online bank acocunt. I was told two different things by two different customer service representatives. Of course one says it’s their mistake, I look online and see the fee pending…the other one changes up (in addition to the email being wrong) after doing some “research” on the account. I hate them to the fullest, they’re all the same, thank God I mostly pay bills and get groceries only from this account. They suck. They’re efficient with online bill pay–only if that bill is through them. Disgusting. I’ve been talking about banking somewhere else for 2-3 years but I don’t know how efficient their online bill pay is. I want to be like the old people that didn’t trust banks. Stuff money in a safe or a mattress and stay away from corporations. God is watching, obviously they don’t believe in him for their shady tactics to swindle people out of their money.
I had $20 worth of CREDIT on my credit cards which BoA owed me, nevertheless, they decided to raise my interest rate from 12% to 24% even though I have an excellent credit score. When I called to ask why this was, I was told that it was the ‘economy’ and the manager raised her voice and was quite rude to me. I was going to do a balance transfer and when I told her this her tone changed, until asked her how I could trust that they wouldn’t just raise interest rates without cause. I was very calm and courteous. Funny, she had ‘technical difficulties’ with her phone and had to hang up, but told me she would call me back within the hour. Needless to say, I waited and never got a call. I wonder what page in their customer service manual it says “Because we value our customers, feel free to lie to them and hang up on them if you feel like it”?
Be very careful that what you say here is 100% true because they just might be litigious. And that’s a true concern now because they obviously have shills here defending them now. And I don’t mean John, who thinks your suffering is “hilarious”. He’s disclosed that he actually works for BofA.

Bank of America is so large and bloated, one hand doesn’t know what the other is doing. I have tried for months to change my addresss, and they changed everything except my zip code… kind of important. 5 months later, some customer representatives have my old zip and some have my new. My mail is still getting lost, and I have gotten every credit card bill after its due date.
Second, I legally changed my name 7 months ago; but they will not recognize the change. I have all the legal paperwork, but they also want a copy of a utility bill with my correct name and address. I rent a room in someones house, I have no utility bill. This is further complicated by the fact that half the time they are not sure what my correct address is.
And the final act of bull shit is Bank of America decided to get rid of their pet rewards credit cards. Ok, I can deal. But I had 8,000 points. I use them to pay my dogs medical bills. I ask for the rebate form well in advance, making sure to ask if the points would be honored. I receive the rebate form, send it all in and ….. nothing. I call them and they tell me the program no longer exists and I have no recourse. But in January, these same people told me I would definately recieve my money, BECAUSE I asked for the rebate form before the program was closed, and therefore used the points I had acrude.
And the best part is the points were non transferable. Use them or loose them. I did use them, and I will not be reimbursed. Bank of America, keep screwing over your customers, soon you won’t have any.
I canceled the card, and you can take those point and shove them!
BOA–Satan, is a piece of shit! Those who say that we don’t manager our money well are plain stupid. It only shows how blind you are of Satan’s manipulative, sleazy ways. I can top all of these stories:
I finished my MBA in May 2008. Shortly after graduating I took a job at a small but highly reputable investment firm. Also, I was able to easily meet all my expense obligations. Unfortunately, given the economic environment I was laid off 5-months later. Given that the financial services industry is in major flux and no jobs exist at the moment I was forced to take a job at a considerably lower salary (less than half) in a different industry.
As a result of the unfortunate turn of events, and my much lower compensation, I am now unable to meet my monthly obligations (I live in the red). I applied for a loan modification. I meet every single criteria (for example: my mortgage payment is now 70% of my pay) and I proposed to the bank a modification that would lower my rate and lengthen my time to maturity. The proposal would ultimately lower my monthly payment but allow BAC to recoup the same amount of money they would under my original agreement.
I received their response last week and the monthly amount they now wish me to pay is actually HIGHER than my original monthly payment. Now I ask: If I honestly can’t make my original payment, how in the world am I supposed to make a mortgage payment that is higher than the original?
So I looked on the back of my modification agreement and saw a line that read something to the effect of “For questions about your loan modification call XXX-XXX-XXXX). Of course I called the number on the back of the modification agreement and asked that exact question. The woman on the other end said that she doesn’t have the authority to answer any questions about loan modifications. I then asked her who should I call. She said “I don’t know” and hung up on me…
It’s important to note that I’m not looking for pity and I’m 100% not looking to take advantage of the loan modification program. I am an honest, hardworking person who didn’t overextend himself. I was just caught up in this ridiculous mess and need some relief or risk being homeless.
I’m new to all this hating, and to be honest I don’t like to be around this much negative energy. BUT, I am furious and need to vent. I hope I came to the right place.

Today in my frenzy I talked to several friends hoping to find a good place to move my accounts. I was shocked when every single one of them I called had a BofA horror story to tell. I’ll share the best one and then quit boring you all.
Joe has had numerous accounts with BofA for many years. Joe has had a successful business in addition to a high paying position for more than 20 years. Joe wrote a large check from his equity line a couple of weeks ago. BofA refused to pay the check. The payee called Joe and was obviously upset. Joe assured the payee that he would sorth things out asap. Joe called BofA. BofA told him that they had frozen his line of credit due to the radical decrease in property values, despite the fact that he owned nearly 100 acres of desirable land free and clear. Joe asked the rep when they planned to share this decision with him. He was told that a letter had just gone out in the mail.
Summarized version: BofA cancels line of credit without notifying customer.
Customer writes check on closed account.
Payee can’t bank his check.
Customer loses face with vendor.
BofA charges customer fee for writing check on closed account.
Customer complains.
BofA sticks to their guns, applies the fees to a live account, and tells the customer tough luck.

I recently started my search for a house. After every bank in my town blew me off I was told to go Bank of America. I called them and they approved me over the phone. I had never done anything so easy. So I got approved, found my house, and set a closing date. I have been emailing boa for a month getting all the paperwork done. Well here I sit just 2 days before my closing date, and I just got an email from them stating I don’t have all my paperwork done and since I didn’t get it to them already I will not be able to close on my house. So now I have no house to move into….and I have to be out of my apartment by next week. So Bank of America just made my wife, my 7 month old child, and I homeless. Fuck you Bank of America!!!
i go there to deposit all my roomie’s checks and we have to write one big check for rent that is due tomorrow.
so i deposit about 5 different checks, all about 200 dollars (or less) each. i have done this lots of other times.
boa put them in my account but tells me the money wont be available for a week becase they are holding the checks. i ask why, because they havent held checks like this before. they say, oh there could be a few reasons…
they say the checks arent local— every single one was local
they are for a large amount, over 500 dollars— they were all 200 or less.
they havent deposited checks from these banks before— they did just last month.
what the fuck. so did i write a bad checks and undergo returned check fees or did i turn rent in a week late and undergo daily late fees?
bank of america was no help, and would not even give me my checks back to go cash somewhere else and get a money order.

I hate Bank of America more than anything. I have been with them for 7 years now and I am closing my checking account and will stop using my credit card. They charge you up the a** in overdraft fees for HOLDS that THEY place on your account. So, even if you have a positive balance when a charge debits out of your account, you can still get charged a $35 overdraft fee because they HELD your money for something else. Case in point: I had five charges on one day – one for $1.25, one for $1.75, one for $4.35, one for something else, and a. authorization for $17.67. That $17.67 did NOT POST that day, but they instead held the money from my available balance. What did post that day were the other 4 charges and because they had held the $17.67, they charged me three (3!!!) overdraft fees in the amount of $35 each on those small transactions because they had HELD $17.67 which didn’t even debit that day! My available balance was in the positive, but not my “available balance with authorizations and holds”. Then the next day obviously my account is in the negative and when that $17.67 finally does debit, they charge me ANOTHER $35 overdraft fee!!! What winners! They have come up with the best scheme in the book!!! They will hold YOUR MONEY from you, and then penalize you because THEY held it. They are double-dipping and STEALING MONEY! It’s about time someone came up with a civil suit against their disgusting dispicable a**es. Plus, it’s no use explaining their illogical practices to their customer service peeps on the phone because they are STUPID. One even tried to liken my situation to a child playing with building blocks!!! WHAT MORONS. They come up with really illogical irrational schemes and hire stupid people to explain their stupid practices for them! Way to go Bank of America-you are capitalism at its best. I actually commend you for being so evil in coming up with the best scheme that you could.

His response was, “Is their anything else I can help you with today.” I said, “Come on don’t you want to repeat your statement about my loan terms for the attorney general in Washington DC to hear?” Put me on speaker phone and I could hear people in the background (call center) freaking out over my call.

I read an estimate recently that stated when all the bailout money, taxbreaks, etc are all handed out, that money given to Americans would equal $50,000.00 dollars for every man, woman, and child in our entire country.
In my family, we have 10 members which equals $500,000.00 dollars. I think that money given to all of us would have stimulated the economy 35 times greater than giving it to the Banks and Wall street!
Hell, there would be all new cars in our driveway with that kind of money not to mention a home makeover and remodel as well as several trips to the mall.
I also saw several posts about filing a class action lawsuit against BOA. Don’t do it people because it allows BOA to mitigate all the lawsuits down to a smaller settlements and forces everyone involved into signing very restrictive non-disclosure agreements to protect Bank of America’s PUBLIC IMAGE.

I am a current BOA employee. I have been there for almost 4 years now and I absolutely hate them as an employer and do not even bank with them because of the terrible service. Since there seems to be a hiring freeze everywhere I am stuck working for this shitty company and listen to people bitch all day. My response to them? Exactly what the bank makes me say “I apologize for the inconvenience, but will be sure that you receive a refund of your application fee…do you have any other questions??…thank you for choosing Bank of America…have a great day!”

I have banked with them for over 25 years, and seven years ago I went to purchase a new (second-hand) vehicle. I allowed the dealership to search for financing, and all I ever knew at the time, was that I was approved through American Honda at a rate of 4.9%. I had financed a previous car, a Honda Civic through American Honda, several years earlier. A couple of weeks later, I received in the mail a ‘letter of regret’ from Bank of America that they would be unable to provide me an auto loan. Ironically, had they not sent that computer-generated “Dear John” letter, I would have never even known they had rejected me, as I didn’t know the dealership had applied with them in my behalf.
More recently however, I’ve been fighting with them over my BoA MasterCard. It began as a 14.9% credit card, but over the years the rate keeps climbing. I would periodically call them and ask for the rate to be lowered. Most of the time they would lower it, but in a month or two it would be back up again, often times higher than it was when I had last called. At one point I was told that the reason my interest rate was going up, was because I was becoming more of ‘a credit risk.’ Strangely however, my line of credit was also rising. I would have thought that if I were a credit risk, why extend me MORE credit? It was apparent a trap was being laid by these selfless, money-grubbing bastards. Currently my credit card interest rate is almost 28% and even though I have discontinued to charge on the card, it’s all I can do to make the minimum payment each month. After reading Kevin Trudeau’s book about Debt Cures, I called and spoke with a representative about lowing my interest rate. She promptly told me I didn’t qualify. When asked why, she said because I was late on a payment within the past 6 months. She was right; I was ONE day late making an online payment…but damn it, they change the date EVERY month, so it’s very difficult to keep track of when it’s due. They will often make the payment due date on a Sunday, when a payment cannot be credited. Taking Trudeau’s advice, I asked to speak with her manager. I was flatly told “no.” I made several attempts to speak with a manager, I was repeatedly told “no.” I suggested to her that I could retire this entire amount – which I would do – if they would not work with me and lower my interest rate. She suggested I either do exactly that, or consult a credit counselor. I told her if I did pay off the balance – over $12,000 – then BoA would not make another dime off of me, as they had been enjoying quite a nice ride at 28%. She got really beligerent with me, told me those were my ONLY two options and I could NOT speak with her manager. I told her, “You know you’re running a scam, right?” She replied, “Sir I’m sorry if you don’t like the answers you’re receiving, but that is all I can tell you; you do NOT QUALIFY FOR A LOWER INTEREST RATE!” …and then told me ‘if there is nothing else I can help you with, have a nice day.’ Hell, she didn’t help me with ANYTHING!
I don’t blame BoA for my balance…that’s my fault. I am a single dad trying to raise two children without any help from their mom. The majority of the charges were for food or things like home repair or clothes for my children. What I DO blame them for, is the LEGAL yet SHADY practices in which they operate. What they do should NOT be legal…when I signed on, I accepted the terms of 14.9%…I had no idea that would balloon into 28%. I suppose I could have discontinued using the card at some point, but I was struggling to make ends meet, so I had to rely on the card. IMO, it should be against the law to charge such outrageous rates and to have such outrageous fees associated with the use of the card. One day late on a payment will cost you an additional $39, and (apparently) prevent you from being considered for a lower interest rate for a period of time. I will never believe that paying one day late cost BoA $39, the amount they charged me.
While operating within the parameter of the law, Bank of America MasterCard – IMO – is run by crooks. PLEASE take my advice, and NEVER, NEVER, NEVER, NEVER, NEVER do business with these sorry sons of bitches. I’m taking a 4.25% loan from my own 401K account to pay them off, and then I want to make it my QUEST IN LIFE to get to word out to as many people as possible to NOT do business with these theives, because they WILL ROB YOU BLIND. PLEASE listen to what I’m saying, use MY HORRIBLE EXPERIENCE for your own gain, and do NOT DO BUSINESS WITH BANK OF AMERICA MASTERCARD!!!!!!!!!!! For EVERY PERSON I can persuade to go somewhere else for credit other than Bank of America, it’s just that much less money they can greedily line their pockets with. While these people may technically be operating legally within the law, there is no doubt they are completely and totally MORALLY BANKRUPT!!

I had the exact same problem with them. My interest rate was raised from 7% to 29% because student loan debt that I had when I first opened the card was now considered too much of a risk. It’s funny how it wasn’t such a risk when I was offered the card. And you are right…..if you’re such a risk, why do they continue to increase your line of credit? I think they are evil and I hope more people read this site.
I will never do business again with BoFA and it’s funny but obviously a ton of people feel the same way.
For several years I had an overdraft account of a few thousand dollars with them. It was like a credit line with no actual credit card. It shielded me from the overdraft fees, and over the 2 years I probably overdrew a half dozen times and paid them back immediately. I never held a balance in that account. One year they decided to cancel the overdraft; I had never abused the plan and it was one of the main reasons I opened the checking account with them to begin with. My credit did not change significantly, and in fact my credit has trended up in the last decade.
So fast forward to a year later and I paid most of my bills online automatically. I had several business related and personal bills that paid automatically. Some of the accounts were setup in such a way as to automatically deduct from my account as needed, so it wasn’t something I could schedule. Over the course of three days a few charges occured which I wasn’t anticipating and I overdrew my account by about $56 total.
Here’s the fun part about these awful people – since the $56 consisted of a number of small charges [like a starbucks] and a number of “transaction fees” which were separate – they charged me $350 in overdraft fees.
THEY CHARGED ME $350 OVER 3 DAYS FOR BEING OVERDRAWN BY $56.
I later read that they had re-designed the order that they process payments in order to maximize overdraft fees. BoFA did not notify me in a timely manner that these fees were being applied and they continued to allow the automatic deductions with caused more fees.
I know their computer system is capable of rejecting charges if an account is overdrawn, they simply did not do that because they designed it to get the fees.
I cancelled my service ASAP. I will never do business with them in any way shape or form again.
The suck part right now is that I have a corporate card from my company – and it’s BoFA. I have already heard rumblings from within the organization that BoFA is screwing us around. Of course they are, they are effing evil and greedy.
I am so leaving BoFa but now I don’t trust any bank but we have a company (small) but have to print checks, pay bills, etc. Does anyone out there have any good stories about any banks? I need to move fast because as soon as they release the hold on my deposit (which I know is sitting there accruing interest) that money is so outta there — I hope. They’ll probably steal it from me. Please, just one little good experience from any bank would be appreciated.
Here is my nightmare that happened this morning.
I went to draw out $200 from the machine and it did not give me my money and then it stated to talk to the bank teller because there was an error. It deducted the amount from my account but did not give me the money. So I go up to the teller named Elsa and told her what just happened. She stated she could not credit my account and that they do not maintain the machines there. That I had to phone the bank headquarters and tell them what just happened.
Then to add insult to injury, I went to draw out an additional $200 from the bank because I needed cash as I was going to Costco. So she asked for my photo ID and I handed it to her, but since my ID expired on my birthday last week and I haven’t had a chance to go to the DMV to get a new one she would not let me withdraw money from my account. This despite the fact that it was obvious it was me on my ID. So I had to use the phone located at the branch and sit on hold forever. Then I finally talk to a customer service rep about what happened and which machine it was, etc. Lots of people kept coming up to that machine and they put no out of order sign on the machine despite the fact that it robbed me of my money. I was on the phone next to the teller station between the cash machine and where the tellers were and talking to a woman on waiting to use that phone to talk to the customer service. The teller was not involved in my conversation but I told the woman behind me what just happened and that I was thinking about switching banks due to this. This is not the first time I have had customer service issues with Bank of America.
Anyhoo, the teller inserted herself into my conversation and started talking about MY ACCOUNT WITH A TOTAL STRANGER. That was the final straw. So not only did Bank of America rob me of my $200 and not allow me to withdraw any money from my account but then they shared PRIVATE information with a stranger. I am beyond livid.
So then I had to drive across town to the other Bank of America location and attempt to withdraw money. I couldn’t withdraw the full amount I wanted because the bank machine thinks I withdrew a certain amount and there is a withdraw limit with ATM machines for a given day. So I was only able to withdraw $100 for going to Costco and had to borrow an additional $100 from my mom until tomorrow when I am allowed to withdraw more from my account.
When I spoke to customer service on the phone they will make a ruling in 45 days to see if I am allowed to have my money that they robbed from me. They will temporarily credit my account in about a week for the $200 but it is no guarantee that I will get it and that they will determine if I am allowed my money in 45 days.
Needless to say I am pretty livid about what happened. Anyone know a good bank in the area? I have been a customer of Bank of America since 1990 and have never bounced a single check and this is the treatment I got. The absolute insult and final straw was the bank teller discussing my private bank information with a total stranger. She was not invited to participate in my conversation and to just start telling a stranger about my account information was just too much. My conversation was only about the ATM and mentioned that since my ID just expired I also could not withdraw any money from my account. Then the teller went on about my account information to this woman. I was in absolute shock she did this!
So for now I am out $200, and all the other insult to the situation just put it over the top.
I am now bank shopping. I will be moving from my Bank of America relationship and will be an ex customer shortly. What a nightmare as I have payments set up with that bank account for bills, etc. This is going to be a hassle to change banks but with what just happened and the treatment I got from that teller was the final straw.
hey asshole,when u get two fees from using an atm that doesnt belong to ur bank, one is from that atm and the other is from YOUR bank. in your example u blame it all on boa thats not the case. and if you think boa is the only bank that does that your a retard
USAA will actually refund the money charged by the other bank’s/credit union’s ATM. But yeah, it is a pretty common practice being charged by both banks.
Being a customer of USAA (switched over about a year ago) it is just refreshing to know that not all banks are predatory like BofA…some still believe in smart, fair, and honest business.
I tried to call a BofA associate who left a voicemail message for me. He referred me to the 800 number to resolve an issue I had. However, I needed to talk with HIM, so I looked up the number for the branch where he was located. I found out through trial & error that the “main” phone numbers for BofA branches are obviously bogus numbers. I defy anyone to place a phone call to a published branch phone number and actually reach a human on the other end. What happens when you call is, the phone rings a number of times, then the call diverts to the general BofA 800 number, which is an irritating voice response system, which will take you through several annoying steps before you can actually get a representative on the line. If you ask this person to transfer you to a branch number, they will transfer you to the “main” branch number again, and you end up in this circus-like circular spin again, never reaching anyone at the local level. Why does BofA not want you to reach employees at branches? I know from past experience that there are bankers who have direct dial numbers, but the 800 number people will not give you direct numbers. WHY? What are they trying to avoid? Good customer service?
What can we do to stop this? Oh, by the way, they’ve been sued. They keep posting transactions on online banking in the wrong order and I’ve gotten fees for it! I’ve put in money and had them charge me an overdraft fee by listing that the money was put in after the charge! It’s ridiculous!!!!!!
I also had like 5 overcharges for about 10 dollars total and got charged around $200…then was told I would have two of the fees removed…had NONE removed and then I called back, was treated AWFULLY and only had one removed. Then when I put in a large…very, very, very large check that I had been waiting on, they put it on hold for DAYS!!!!!!!! I needed that money and the teller/manager told me it was because my account had been overdrawn…well I had put in enough money to pay back the $10 I owed but apparently they feel the need to STEAL MONEY in overdraft charges! I HATE THEM!!!!!!!!!!!!!
I hate Bofa and not only have I been a customer for 20 years but I have also worked there for 10 years. If you read these comments it looks like people are upset about returned items and the fees bofa charges. Someone even made a comment that those complaining should learn to manage their money better…..well the feeling you have for bofa as a consumer permeates the entire institution. This is not about returned check fees but more about a large institution raping and pillaging the lower classes. I have seen some of the poorest customers who take in only government income with BofA charging over $200 a day in overdraft fees for $6-7 dollar overdraft items. The branches can waive these fees but will eventually get fired if they do.
They treat their employees so bad its shocking. Personnel is off shore in India. If you are a manager you are a protected class at bofa. The monkey business and games the management team plays is amazing.
I have seen managers scream and yell at employees using profanity and the employees have no recourse. When a branch manager has been with the bank 25 years, they dont care who she/he yells and screams at as long as the numbers are there.
Ken Lewis mission was to grow BOFA to the biggest bank. Not profitability but sheer size, sheer ego. As a consumer you are now dealing with the people and cultures of MBNA, Household Finance, Nations Bank, Merril lynch, etc, etc…The only common thread amongsth these institutions was their zeist for profits at the expense of morality and doing the right thing.
Its time they break them up like the old ATT.

I had been using credit unions the past 4 years and couldn’t understand what people would complain about banks for. Now, I know.
I got Bank of America by a promotion of a baseball shirt. Since I was in the military and am now living at home in a different city, there are no credit unions nearby, so I decided to try a bank. Big mistake for youngsters like myself. Luckily, the gentleman I started my account with explained to me EVERYTHING I could think of asking about, but what’s scary is what I really found out.
BofA (worst-dubbed abbr. ever!) has a policy to charge you $8.50 a month for not: a) having $1,500 in checking account every month, or b) have direct deposit into it. With credit unions, I didn’t have that problem. Luckily, the guy who helped me got me a deal of “student banking” & military banking”- which just means I don’t have to pay those horrendous fees, which really shouldn’t be there in the first place.
My problem is the corporation’s policies. If you deposit a check, your funds are not available for 10 business days, and because of the holiday/deposited on a Friday, I have to wait 17 ACTUAL DAYS TO GET PAID. Alright, I didn’t know that, and didn’t find out until I took a trip almost 300 miles away, in another state. (Thankfully, it wasn’t an emergency. I still had a credit card, from my credit union.)Therefore, I started my acct. with $100 in it, deposited a check for about $750 (so, $850 total), and then withdrew my “available funds” for $200 the next day. I thought it was weird I couldn’t withdraw the full amount like I wanted to, but thought, “Okay, so maybe the guy lied to me, and I can’t withdraw $700, only $200 a day from an atm.” That would be fine, except when I tried going the next day, I couldn’t withdraw ANY cash from an atm. That Tuesday, after Columbus Day, I went to a teller in NV, who told me I didn’t have any funds in my account (she said ANY, even though I should have $650 left) and explained they can’t do ANYTHING about it at the bank, and to call BofA to find out why. I was explained my check was held for 10 business days, putting me at the 20th to withdraw from my account. “Why was I able to withdraw $200 then?” I asked, knowing I didn’t have $200 before that check. The lady explained to me that Bank of America gives us $100 to be able to withdraw immediately, but no more until the check is “resolved.” Well, “Why wasn’t I explained this before,” I asked her supervisor, and was told that all the ATMs disclose that my check deposits MAY be subject to a hold, meaning it can be done “WHENEVER BANK OF AMERICA FEELS THEY NEED TO,” AND “IF CAN EXTEND THAT PERIOD (of 10 business days) WITHOUT NOTIFICATION.” I thought this was more than ludicrous, and asked my complaint to be submitted verbatim to the Bank of America Corporation, but the lady only stated that she would type up the report to be forwarded. Also, I’m not sent any notification whatsoever unless I complain via mail, so I asked for the address to send to them there.
Another thing is, “for future reference,” I can deposit my check with a teller, but the same policies & procedures apply, except that I SHOULD receive a letter explaining my check was placed on hold. When I asked on the phone conversation, “WHY CAN’T BANK OF AMERICA AT LEAST TELL ME when they place my check on hold,” I was explained that they don’t at the moment. Apparently, Bank of America’s been living in the middle of century, before modern telephones/cellular phones were invented.
So, defeated at this battle by no-faced voices reading ancient scriptures of rules & bank policies, I decided to lick my wounds & die another day, lastly voicing, “If I ever knew this was going to happen, I wouldn’t have ever banked with Bank of America.” It’s much different from a credit union. “But that’s not as safe,” she told me. “At least if everyone’s taking my money from my acct, I would be able to, as well,” I retorted.
If “ALL BANKS ARE LIKE THIS,” like she says, then f%$ them, I’ll just drive 100 miles if I need to to get to my credit union.

It’s funny you mention “AT&T,” because growing up, I’ve heard bad about them; Then, they took over my dear Cingular (which I liked); unfortunately, I’m paying my own bills now and am dealing with their horrid cellular service & terrible customer service; I miss the old gel figure’s company that they murdered by combining into their blood-sucking “ATT-tack” corporation… but that’s for another thread.

Me: “Hey, I realized that I accidentally went negative on my account yesterday, it’s the end of the month and I get paid tomorrow but you know, money gets tight when your paid once a month haha”
BofA fucktard: “Oh yes haha, I can understand that”
Me: “Well, I transferred money from my savings account to take care of the negative balance, it was only like 5 bucks for the 5 purchases, I bought a couple of snacks throughout the day, love them snacks you know haha.”

Have had a business LOC with BOA for 2 years. Last time we used it was Feb 2009. Always on time, never late. Got a letter increasing our rate from 5.25% to 9.48%.
We also pay an annual fee of $425.
Called the # ont he letter. Why?
First they said because of competitive market. I said if that is the case you should be LOWERING rates, not jacking them up. Second, they said it was because the cost of money went up. Told them the fed rate has not changed, so your cost is the same. Third, they said it was because of losses.
So there it is. Good folks paying for the bad folks. Our company hates BOA.
To be Honest I work for bank of america i dont do much of my banking there, so i know how it is in there with policy and procedure but seriously i read all your problems and there is nothing creditable in your claims, I always have the same complaints everyday and sometimes I feel and understand how hard it might be for some customers but sorry to say its the customer at fault but yes i can say the bank does mess up at times… but really we all make mistakes as clients and businesses most banks are all the same issues same fees and what not , I have also been a victim of human error were my mistake wasn’t reversible but basically it just means for me to be more careful. BUt like always I am glad to try to help you as much i possibly can in the office. we all make mistakes but we learn
Bank of America is the worst bank in the world. I had a credit card with them for 10 years. I was never late or over the limit….never! Three years ago they decided I was a risk because of my student loan debt and raised my interest rate from 7% to 29%!!! The first year I made several attempts to have it lowered back, especially since they initially offered me the card when I had the debt. They lowered it back, but two months later increased it again. They suck!
I am an international student studying in the U.S. for a graduate degree. I used to hold a highly lucrative job before but as of now I don’t have a job and at this point every dollar in my account counts. When I came to the States and opened an account nobody told me if I banked with Bank of America they would financially rape me. I am moving to a new bank on Monday because I’ve really had enough of this.
(I’ve read every post on this site and I know exactly what people are talking about and how they feel)
Here are just SOME of the problems I’ve had:
1) A couple months ago I was making a purchase of something that cost around $2,000 dollars. It’s a long story but it took me 3-4 HOURS to make this purchase because I had to call B of A customer service 3-4 times and also physically go over to B of A two separate times to make it happen. I have several accounts with B of A and this account was an account that had relatively low bank activity. I understand that banks can watch out for “fraudulent activity” but don’t make me be on the phone for 2 hours and then walk out of a store and get in my car and go to the bank 2 times because your customer representatives (none of them) knew what the heck was going on. I’m so tired and it’s so stupid as to what went down I don’t even feel like elaborating. Basically, the first customer rep I called asked me for my Passport # – I’m sorry, I travel very frequently and so do all my friends (who are a bunch of people who grew up in different countries all over the world) but not many people memorize their passport digits. From the country I am from passport numbers aren’t like SSNs they change every time you renew the passport. Anyways, I gave her my SSN (I’m not a citizen but I have one) and all this other correct information but she purposely tripped me up with the passport number and treated me very rudely and didn’t give me access to my account. I really personally felt that this customer rep DIDN’T want me to access my account. It was very bizarre. When I asked to speak to her manager she said no.
After this phone call, I left the store and went over to a bank to clear the problem. The banker there told me that everything was cleared. I went back to the store and tried to make my purchase again and the card (debit card) was still not going through. Then I called customer service again etc etc. After spending about an hour on the phone, I went back home, got my passport (armed with all sort of IDs) I drove over to another branch of the bank and they didn’t know how to fix the problem. They said I had no holds on the account (their computers told them) and that I should have no problem accessing money in it. So then what was I doing the past three hours running around town?
Eventually, I ended up transferring cash to another account and then made the purchase using another debit card. But if I had known this in advance I wouldn’t have had to go through SO MUCH TROUBLE TO SPEND MY OWN MONEY.
Not to mention all the damn trouble I caused the lady at the store. I was embarrassed to say the least. It looked like I was someone who couldn’t afford to buy this product who was scrambling and begging the bank to lend me money or something.
2) Overdraft fees. For reasons many have aligned above (the whole pending issue and what not) – one of my accounts have been recently charged for overdraft fees of over $400.
I am very responsible with my finances. I’ve never missed a credit card bill in my life and have never had a check bounce in my life. However, two weeks ago one of my bank balances (the one that I use the most for groceries and paying bills) was out of control because the balance kept fluctuating. I HAVE SIGNED UP FOR ALL BANK ALERTS including emails and text messages and I check my online account every day. And I had no idea what was going on because the bank alerts were behind (they didn’t show “the most recent” activity as they should) and my online account in 4 hours went from something of a $200 balance to NEGATIVE.
It’s a long story but there was a bill that was over a hundred dollars that fell off and the banking system didn’t even note that so I was really confused as to what was going on. Bottom line is I was suddenly overdrafted on 13 different occasions and the total came up to 13*35 = $455
This was right before Thanksgiving. I was in the process of writing my thesis and trying to wrap up the semester, but I made time to go over to the bank personally (two different banks) and spoke to ppl there. I didn’t mean to but I ended up tearing up a little. I was really upset and I just didn’t understand how a bank can do this to their customer.
At one of the banks the manger asked me if I wanted to open a credit card with B of A but said there was nothing she could do about the fees. Really? She was trying to make me open a credit card with them at that point?
I also called the 1 800 number 3-4 times. They were very rude and treated me like the scum of the earth. In fact, I just called them just now. (My semester is finally over and I had the energy and time to call them again.)
I hung up with steam coming out of my ears.
I am moving banks no matter how much of a hassle it is on Monday.
3) I drop off my rent around the 29th of the month and always have my checks signed for the 1st of the month.
When my apartment charges me on the 29th or so, even though the check is marked for the 1st – money is still deducted from my account. Is that legal?
4) The ATM balance, the online balance, my phone alerts vary at times. It’s the same account but the numbers are different.
I just think that’s really messed up.

I’ve been to many banks in different countries and this is really something. A country so advanced as the U.S. should not have banks like B of A operating on such large capacity.

I hate them. They have taken over $2,000 in overdraft fees due to their holds on my checks. Not only that but they charge overdraft fees and then return the check and then I find out that I am late and my credit score goes down. They can’t make up their mind. Either they honor the check but don’t return it AND then charge overdraft protection. There is no protection. I am going to probity banking and living off of cash for now on. That’s the only way to go. you put your money in a bank and you can’t figure out all their byzantine rules on which checks get held and each type of check is different. Even sending checks is different. Some takes a day some takes 5 days with their on-line bill paying account. Banks are their to skim off fees. The old days you used to put your money in the bank to get interest. Now you put it in the bank for the convenience. But there isn’t any thing more convenient than putting $1,000 under a mattress becuase I don’t have to drive out in the snow and rain to get my money when I need it. That’s what I do. I put my money under my mattress every month. I am saving money now! Finally.
Every one in the country should file get rid of their Bank of America accounts, and switch to another bank. Other countries totally control the U.S. We are in a sad state.
Bank of America sucks along with the other banks, Bank of America charged me over 200.00 for a 12.00 overdraft, they got a bale out but continue to rob their customers. I am paying them over 2 thousand dollars a year in interest and will never stop paying them. I am filing bankruptcy this year, they are screwing me I am going to screw them. I would love to pay my debt, but I am not going to pay this crazy interest rate.
I got a credit card from these scumbags in 2004. I was late 1 TIME AND 1 DAY late and they jacked my interest up to 27%. They are nothing more than mafia.

When I called to try work something out because I had lost my job and and couldn’t make the next months payments of $44 yes just 44 dollars per month. I got transferred to some financial guy. Who told me they were fed mandated and if I didn’t have any income there was not thing they could do for me. They then proceeded to charge me late fees for the next 3 months of $35/mo. After I finally got caught up and paid 3months in late fees and the three months of 44 dollar payments. The next month, that is this month (Dec09) they raised my monthly interest rate to 28.75 percent apr. IN ANTICIPATION OF UPCOMING LEGISLATION.
Now, ALL THIS ON A LOUSY $2200 monthly balance the interest is more than the monthly payment.

I have a mortgage that was bought up via Countrywide by B of A. I was laid off in November and have (with unemployment) enough reserves to last maybe 5 months. If I can reduce my mortgage payment, I can make it 8-12 months.
I am attempting to get a TEMPORARY reduction in my mortgage payments until I can get a job. TEMPORARY REDUCTION! Not a refi, not a modification, just cut my payments in half for 6-8 months and then let me pay the difference back over the next year or what-ever.
Not happening so far. I have spent hours on the phone and talked to multiple departments across at least 2 continents (maybe more) and can not get a straight answer from anybody! I want to keep my house, I want to pay my bills, I want to pay my mortgage I JUST NEED SOME HELP OKAY? Is that too fucking hard to understand?

I am writing to you concerning the loan modification performed on my loan in Sept. 2009 by your company and overseen by ______________as per your request. As you know I was referred to you as a result of my request to my United States Senator, Saxby Chambliss to open a Congressional Inquiry on my behalf regarding my pending home foreclosure by your company. The first modification I was offered was called, “The Home Saver Advance” which I found out after investigating was offered by a 3rd party firm through Bank of America and didn’t really help much at all and I declined It. I was then offered the modification I presently have. As a result, after my investigation, I feel that I was lied to and told that this present Modification was to be done under President Obamas, “ Making Home Affordable Plan”, which reduces home owners mortgage balances and interest rates to reflect their lowered income and the loss of value to their homes as well as gives financial incentives when borrowers make their payments on time. I was never informed about any of this prior to my modification. This modification was closed without an attorney to explain to me just what it is that I was getting into. It is also customary for an attorney to be present during a mortgage closing. If I had known what all was in the closing papers, I never would have signed, but I was lied to and I trusted what I was told by the bank. Furthermore, the Presidents plan prohibits the lender to charge the borrower any fees to do this modification. This is clearly stated in the rules which state under FEES/CHARGES, “There are no modification fees or charges borne by the borrower“. Instead, the modification I was given only took my delinquent payments and put them on the back of the original loan and further saddled me thousands in fees and which the bank also put on back of my loan not only raising my loan balance but extending my loan another ten years. Now I have none or negative equity in my home. When I protested this to Mr. ______ he stated that it was they best they could do, the terms were fixed under the Presidents plan and that it was a formula they were required to follow. As I found out later this was not true and that my loan Mod was not even a part of the Presidents plan. My interest rate was reduced but raised in increments during the life of the loan. In addition, the first month of this modified load gave me three payment options but now it appears that my payment has returned to its original amount that I cannot afford. In addition when I applied under the Presidents,”Making Home Affordable”, plan the Bank of America Representative told me and my HOPE rep. That I was not eligible because I had already been modified and could not apply until one year had passed. When I protested I was basically told ,”too bad you signed it”. In my opinion this is basically, “ loan sharking”, and should be prosecuted under the Federal RICO ACT.
In short, I am requesting that you look into this matter Mr.______________, I have been hit hard in this financial crisis, real estate market and recession and when I came to you for help this is what I got from Bank of America. I am amazed at the corporate gall and greed of this bank to further unjustly enrich itself even in the mists of a congressional inquiry. I was duped into this unfair loan modification which only makes matters worse when there was a much better option available to me as a homeowner under the Presidents plan. I am further requesting that my loan be re-modified under President Obamas, “Making Home Affordable Plan” as it was portrayed to me and should have been done to begin with.
I’m sure that Bank of America has done this to thousands across this nation while taking Government Bailout Money and pretending to help homeowners, This type of activity needs to be stopped. I feel this is a scam on the public and the United States Government and implore you to make it right.

After a long, long, stressful days work, I came home and plopped face down into bed. My head was spinning from all the phone calls I received from angry customers. You see, I work in a call center for the biggest bank in the United States, and naturally, we receive a large number of calls. Sad to say, almost 90 to 95 percent of the calls involve us (yes us, the innocent customer service reps) getting our heads chewed off by distraught customers (and trust me, you guys have every fucking right to be distraught!) and dealing with the various shenanigans that the bank has pulled on them. Now I’m not saying that Bof A is the only “shark” institution out there, but after being on the job for almost a year now, I just have to vent about what’s going on in that whirlwind of a place.
First off, let me just say that Bof A is the only company that I’ve seen that charges a ridiculous $20 fee for making a payment over the phone. When I first heard about that in training, I looked over at my co-worker, who was looking to her right to another co-worker, with the same expression on our faces (which was, “WHAT THE FUCK!!!”)
And that is only the tip of the iceberg.
And then there’s the outrageous late charges, fees, and penalties. I’ll just say this… Bank of America is a giant of a company, and there are so many departments that it will make your fucking head spin. If you ever screw up in any capacity (for instance, if you’re ever late on a mortgage payment, or if you miss any other type of commitments with them), then you will pay – BIG TIME! Fuck around and forget to send us your proof of homeowner’s insurance, and we’ll slap you with our own brand of insurance with a premium that will be triple the cost of the one you own! Or perhaps you’ve already faxed us a copy of your policy about 10 or 20 times, and our “insurance” department just never updated it to your account. No fault of yours, but yet, you, the customer, is the one that suffers for it. Happens to about 15 out of every 20 customers, no bullshit.
And for you guys that always wondered about BofA’s wonderful world of financial assistance and relief, strap on your seatbelts, because this is going to be one hell of a fucking ride!!!
Loan modifications – simple extensions of loan terms and interest rate reductions. I’ve heard from so many loan officers that the entire process takes no more than a month. If you request a loan mod through us, hell will freeze over before you actually get one. More than likely, you will speak to someone in our “HOME RETENTION” department, who will ask you a zillion questions about your financials and whatnot, to then tell you that you qualify for a program that will help you. You will then be told to fax copies of things like financial statements, hardship letters, etc, and once you fax it, you hear nothing. You call in to get status, and if your lucky, you will be told that your documents have been received and that your account is “UNDER REVIEW!” Months pass, and you still have heard nothing, so you call back. Status – still under review. More months pass – still under review. Another month – STILL UNDER FUCKING REVIEW!!! Worst case scenario (yes, it gets worse!) you will be told that your documents have never been received, and you will have to restart the whole process!
And I’m not even going to begin all of the craziness surrounding the gov’s mha program. It’s bananas! Once you pre-qualify, you will be told that you will receive documents in the mail in about 45 days. One out of maybe 20 may get them within that time, seriously. Once you receive them, you will be told to fill out the docs (which are pretty much the same ones that you sent in when you originally mailed your hardship documents in many months prior!) And send them in by a deadline date. You send them back, and you hear nothing. You call in, and you’re transferred to about 10 different departments before you’re finally told that the documents have been received and to begin making trial payments, which are reduced payments for the duration of the 3 or 4 month period. The trial period is set up for the customer to ensure that they will adhere to good paying practices while their loan is being “reviewed” for a permanent mod. During review, underwriters will supposedly be checking backend information to make sure that all your financials check out, your credit, that sort of thing. You figure that you’re in good shape and that everything you submitted as far as your financials are concerned are true and accurate, and your credit report is fine, and you also make all the trial period payments on time.
Well, its the end of the trial period, and come to find out, we’ve notified you that you do not qualify for the permanent mod, and that the difference between your reduced payment and your regular payment will need to be paid back. That’s it. No help, and your payment may actually increase from what you were paying before you requested the relief. Thats the fact of the matter ladies and gentlemen. Remember, this is a GOVERNMENT PROGRAM, but the mortgage company can also have their own input into who they deem is eligible, and can turn you away for the craziest shit in the world! For instance, if you were lucky enough to catch the Congressional hearing about Bof A’s loan mod non efforts, The BoA asshole states that one of the main reasons a customer will not qualify or have the loan mod process held up is due to the homeowner not sending back required documents on time. This is absolute bullshit. What’s going to happen is when you send the documents in, you will not get confirmation that they have been received, and will later call to get status, only to be told that you have been disqualified for assistance because your documents haven’t been received!
Another thing, if you’re having serious financial difficulty, you will be advised to go delinquent on your loan for three months, so that you can receive assistance. Of course this is going to leave you a bit skeptical, and for good reason. You have worked hard over the years to build good credit, but unexpected hardships have put you in a serious bind, so of course you don’t want to agree to anything that will impact your credit. You will be told that it will be reported, but that it will not drop your credit score, and will only be reported that you’re going through a “government workout assistance program.” More bullshit. It will drop your credit score, and on top of that, it will be months, maybe a year, before the loan gets modified, and all the months that it will take them to actually modify it, you will be reported delinquent for ALL of those months!
Well, that about wraps it up for my adventures in the world of BofA, guys. Sorry If I rambled on a bit, but I just had to fill you folks in on the “BULLSHIT” that is BofA. They pay us and prey on us at the same time (our bonuses will be taken if we are not one of the top performers in “selling” various bank products. Now mind you, we work in the mortgage department, why the fuck are we trying to sell customer’s credit cards?) Just found this out the other morning in a meeting with my manager. So for instance, if the department goal is to get 20 applications processed for refinances and you only get 19 processed, you receive no bonus for the ones you got processed, only for 20 or more. How fucked up is that? Honestly, after being yelled at for more than fifteen straight minutes, I hardly think that a customer wants to be sold on anything that we have to offer. Agreed?
Thank you guys for listening. You’ve been warned. If you’re with BofA, I would advise you to jump ship immediately! And just so you know, they’re too big to take down. You can complain all you want to whoever you want, the madness will continue. The company mission statement is “to be the biggest, most admired company in the world.” Biggest? Maybe. Most admired? I HATE Bank of America, because they recently cut the line of credit to our business without any notice, impeding our ability to conduct business with our vendors.
Although this will not prevent my company from moving forward nor will it close my company, it has left an incredible bad tast in my mouth, that after, 6 years of doing business with Bank of America, and paying their inflated loan and credit card interests, they would just further impede an individual’s or a company’s (especially those in good standing) ability to do business, for their own personal gain, (IE Bigger and Better Bonuses) .
Bank of America is the least SMALL BUSINESS friendly bank on the planet and I would do just about anything to move my debt to another institution.
They are a modern day loan shark operation nothing more.

I put a check in the bank over a week ago from Trowe Price, the have it as pending so every charge I have made to my debit card since has incurred a $35 charge costing me over $140 in charges for money that is in the back! Recently a buyer of my house went to Bank Of America for a loan in SEptember 2009. Elliot Salas and Paul Radzik worked on her loan. We were amazed at all the things they were making her do. Then they told us they made mistakes and we had to wait 30days for them to correct them. Then they told us we had to wait 90 days finally at the end of January 2010 they tod us we had to give them 6 more moths. Since I bank at Bank of F**K America I called and was informed..they are not lending money but did not want my buyer with a 800 + credit score to get away and was holding on until they get permission to lend. My buyer went to another bank and got the loan in4 weeks. Bank Of F**K America ruined me while I waited for the loan to go throughh and yep these two creeps got a bonus from tax dollars.
Does anyone know how long it takes BOA to reject a direct deposite if the routing number is incorrect? I live in GA and used the incorrect routing number for my IRS refund. Bank of America has two different routing numbers. The IRS is waiting on BOA to reject the refund so that they can mail me out a paper check. The rep claims she does not know how long it may take. The IRS said it may take up to three weeks. Anyone please Help!
Bank Of America, all the people in the states. Do not use Bank Of America at all. They are full of crap!… They will charge you for using your own money with dumb intrest fees that would not make any sense at all. People all over the states. We hold the power. This site is so funny. I never realized how terrible people are at balancing a check book. Seriously, BOFA provides customers with multiple ways to stay on top of their account. They only charge you a fee if YOU make a mistake. If the bank makes an error they eat the fee. Having worked for multiple banks(BOFA not Included) I have heard all these complaints a million times. People are just looking for someone else to blame instead of themselves. It is never your fault that you had an OD fee. It is always the BIG Banks fault. Even though they give you multiple ways to avoid fees because people like the people on this site they have adopted even more ways for you to avoid fees. Such as opting out which allows your account to reject checks or ach debits if you dont have enough to cover it. Therefore helping customers prevent fees. Instead of wasting your time with a site like this why dont you concentrate on the real issues. Such as why so many morons believe Bush was behind 9/11.
it’s funny reading some of these stories, after reading the ones about credit cards rates and have a great point. i know why rates have gone up, its simple just like when you go to a food store when the store has to make up for a lose they hike up the price. i worked in a food store and please all the people that came in yelling about how milk cost so much and how can they buy any food for their kids if we keep hiking up the price, but does same peole have to make sure they have a pack of smokes. I was going to leave a very nasty comment about Bank of America. Whoops, I’m too late. I don’t think I can top anything here.
Along time ago in Tampa, FL, I had a wonderful bank! They took care of my every need, had no fees because of my bank balance, and were even nice to me! They knew my my name! And always has a smile for me! Even travelers checks were free!
Then, NCNB took them over….little did I know Bank of America was taking over NCNB at the same time.
Service got worse and worse each month.
Now, I pay a fee if I want a printed statement? WTF?
Now, I can’t even get Bank of America to understand the difference between my Orchard Bank credit card and my HSBC credit card. Yes, I know HSBC owns Orchard Bank, but THEY HAVE SEPERATE WEBSITES!!! My Orchard Bank login doesn’t work at HSBC!!! Get it straight!!!
I miss my good bank before the GODLESS ASSHOLES at Bank of America took over my account!
BOA has another ripoff for you. Watch out for their “Bill Pay” service.
Several of my bills have always bill electronic bills and paid electronically.
In one month, they decided to pay these same bills by check instead, and did not deduct them from my account. Then, after I though all my bills were paid, the held the amount back and then took all the checks out of my account at the same time, dropping me in the hole and charging me $35 for each one!
Yes, I know I should keep a better balance, but I also depend on the online balance to keep me up to date. If they say a bill was paid, it should be deducted from my account, not pay 6 bills and deduct only 2 of them from my account and then wait to deduct the other 4 three or four days later!
Just another way Bank of America has come up with a way to screw us and make money.
BOA starting in August 2010 cannot add overdraft fees to all overdrafts ( as individual items ) but they will be charging a ” weekly over draft fee” of $35.00. Same thing just re-named.
When Tellers talk you into having the visa logo on your atm card, which does not help because they only tell you part of the reason for the logo visa.( Not all details. ) You walk away thinking if you are low on funds Visa will carry over as a protection, Wrong.
What you do not know is that you have to set up another account for the over drafts but I am sure when they process this there will be a fee! I had my Visa logo taken off my ATM card , I rather have a retailer tell me my card is not accepted than have a $35.00 late fee. Sometimes we continue shopping thinking that check cleared and each purchase is a $35.00 fee. Even if it cleared the next day, those over draft fees are faster than a cleared check!
BOA takes funds out of your other set up account if you are overdrafted for a fee, I am sure.
Example: thinking you had a check cleared, and funds are electronic in your account so you go out for coffee $2.50 ~ funds are not yet in your account that coffee will cost you $37.50! ( add the overdraft fees).

I do have to say, twice I called on the 800 # as soon as I found out that my account was low and my fees were taken off.
You have to call and explain as soon as possible, BOA will work with you. I went to management at the bank thinking a face to face might help but it was a flat no refunds.
I called and talked to the guy) 1-800 # ) on the phone and he gave back $175.00 I did not take the first No and gave up. It took 3 phone calls. Was worth it. The guy on the phone was very polite and friendly.

So Wells Fargo and Bank of America both suck and they really suck when you combine them. I used my Wells Fargo checking to pay my Bank of Amercia credit card. Wells Fargo decided to decline the payment even though I had enough money in my account (they refuse to tell me why). Bank of America decides to charge me a $35 returned check fee and a $40 late fee. I call them to make a payment and they wanted to charge me a $15 fee to make a payment over the phone. No thanks! I decide to send them a money order so I try to log into my account to figure out how much I owe them and it says that there is no account associated with my ID. I’m so fed up with them. They keep doing this crap to me. Two months ago, I made my payment over the phone and they never told me about the $15 fee and my bank account overdrafted. I’m going back to college in a few weeks and I’m getting a student loan. I was going to use it for books and supplies but I’ve decided to instead use it to pay off my BOA card. I hate them and don’t want to deal with them any more.
After Obama’s credit card law on overdraft fees BOA came out with new fees. Yes, it is true that if you OPT OUT of overdraft nothing will be taken from the account but you WILL BE charged $35 fee for trying to do so. What the hell is that? You are charged the same fee ($35) but the transaction is declined. Over the course of my life, I have been affiliated with about two dozen banks in 5 different countries, and by far, hands down, BoA is the absolute worst. I actually have positive sentiments in my memory with all the other banks – I’ve only been holding onto it because I have about 50 checks with them (and no other bank) that I use whenever I have to use a check but realize that’s probably not sufficient reason enough to deal with such a terribly run, consumer-screwing behemoth – this website sealed the deal and I will cut my ties tomorrow, and warmly encourage everyone reading this to do the same.
I worked for BOA the latter part of 2008 in their customer service center in Beachwood, Ohio. I was told by a senior manager (15 yrs service) at that time, the reason they mailed out statements so close to a due date is that they know customers won’t have enough time to mail the payment(s).!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
It was a crappy company, and I was not surprised that a new CEO had taken over. They issue credit cards to people who can barely speak English, then expect their customer service reps to be “patient” with them.
They hire a lot of people who drink the “BOA” kool aid about prosperity at the Bank. It’s a decent job in tough economic times but if you expect to make a real career at that call center, you have a low self-esteem! I met several very smart managers and wondered why would they stay at such a place, complacency????
I work in the real estate industry. I have lost track of how many horror stories I have heard from borrowers using BOA for a home loan. These issues occur more often with BOA than any other financial institution I have worked with. I’ve seen numerous responsible and trustworthy loan officers leave BOA because of their poor customer service and lack of back end support in the lending world. The personal banking complaints from friends and associates are over the top.
Tell everybody you know to close their BOA accounts and go to a local bank or one of the many top notch credit unions that can be found in nearly every community. You’ll never look back.
I agree. I will do what ever I can to influence people to stay away from BOA. They have royally screwed many I my customers, friends and now me. It’s about time they take their heads out of their asses and have a little compassion for their loyal customers. I hope everyone spreads the message to NOT DO BUSINESS WITH BOA. I am in the process of closing out all my accounts with them and will never do business with them again. Shame on you BOA. If I did business like you I would be out of business.
What’s not to hate ? Raised my annual fee, so I iclosed out 4 credit (debt) cards from banks they aquired. No more, BoA should be DOA !

Just another example of how BOA refuses to do anything VISA requires them to do and gets away with it. I found a convenient store that I thought overcharged me for a few sodas for the family. Turns out they charged me a “convenience fee” for using my debit card with the VISA logo on it, not only a violation of Florida law, but also against Visa’s terms of service. I looked online to find out how to file a complaint and Visa’s website said to contact my bank. I spent over an hour on the telephone with Bank of America, passed from agent to agent and finally to a supervisor that all told me the same thing: I need to contact Visa directly, even though Visa clearly states that it is the card issuing bank’s responsibilty to accept the complaint and report it to Visa. Finally, after an extended hold, the supervisor connected me to Visa, who took my complaint. I then received a letter from Visa stating that in the future, I need to file the complaint with my bank, not Visa. WTF???? What do you think I was trying to do for over an hour?

Bank of America is lower then low life. I took out a mortgage originally with
Country Wide they were bought out by Bank of America some years ago.
They have increased my mortgage with out notifing me. I have fallen on hard times. I lost my job May 2007, became disabled in 2008. I cashed in all of my savings to pay them and last year May 2010 I ran out of my savings. I requested from Bof A to get a refinance and the______ loan officer kept putting me off. Stating DON’T WORRY it will work out. ” Just need a little more paper work from you”. Being dumb I believe him as of October 2010 I went into
foreclosure. I sold off some property up North, paid off the back mortgage.
April of 2011 I called BofA stating I need a reverse mortgage, because I will be have huge problem paying the mortgage and again I am told by another loan officer DON’T WORRY you have good credit it will work out, but we no longer
offer reverse mortgages. I can get you a refinace loan. I say GREAT. We go back and forth for several months. Yes the rug was pulled out from underneath me.

$5 a month for the priviledge of using a debit card? I don’t think so! I finally had the last straw and enough to push me over the edge, close my Bank of America accounts and go with a wonderful bank in my local area, Vystar Credit Union. Pays a lot more in interest and even gives me rewards for using my debit card!!!
And the best part is yet to come…when everyone else dumps BOA and we watch their stock drop from an already low $6 and change to under $1 per share because of their greed!
My Vystar Credit Union account is now open. My checking account pays better interest than my Wells Fargo or Bank of America savings accounts pay. My Vystar savings account pays much more!
Now today, BOA announces they will not charge a fee for debit card….at this time….So, what happens six months from now? What other fees will they start charging.
I am only waiting to make sure my direct deposit goes through and my checks arrive in the mail (daycare doesn’t accept electronic payments), then I will close those Bank of America accounts faster than I cancelled Netflix!!!

They almost ruined my life about 10 years ago, as I received my credit card bank statement from them one day and my interest rate had jumped from 6.9% to 24.9%. I called “customer service” and was told that my previous payment was late, so they were able to jack up the rate. But I informed them that I made a payment when I noticed I hadn’t received a statement for that month, however it was late. They said they weren’t obligated to send the statement and the delinquency was on me. To make matters worse, the other 2 credit cards I had also raised my interest rate due to my tardy payment to BoA. It was at the time when I personally believe they were ruining many, many people’s lives with this kind of trickery. I will always hate Bank of America, as well as Capital One, Insurance companies, politicians and most lawyers
I hate Bank of America. Unfortunately, I worked for them. Then I was wrongfully dimissed by an incompetent manager who was jealous of me and trying to force me to do secretarial work even though that’s not what I was hired to do. I am very gratified to see this website and others like it. And I’ve paid-off my credit accounts and will never do business with them again. I hope they go out of business, or at least get broken-up into smaller banks. Then maybe the jealous people who tried to hurt me will get theirs.
I am going to cancel all my account with BOA – I just had really bad experience with one of the sale people . . . I know sale person should sell the company and their products to me – I hate BOA!!!!
B of A closed one of my checking accounts after my paycheck posted, no advanced notice stating that the account balance had gotten to 0 dollars why would they wait until after my paycheck went through to close the account. not tell me they account was going to be closed and then not letting me have access to my money. Like a lot of Americans I live pay check to paycheck, but not this week, I live according to when the bank wants to give me my money back.
